    In Scotland you can only claim back over the past 5 years so as long as the claim is for the previous five years at the point you started correspondance with them.

    Received: £144


    Hi,
    Seeking £360 in unfair charges from Barclaycard. Sent letter on 27th Oct saying i was seeking this back. Received bog standard reply(and to be honest very abrupt). Send second letter with spreadsheed of charges saing you have 14 days to refund the money last Friday(they received it yesterday). Letter i got today was they have taken my complaint on and i will hear off them by the 7th Dec(this goes over the 14 days i gave them in second letter)
    Rang them up to discuss complaint and they had put £144 :D back onto my account today!!

    I said, i would accept that as part payment and would be seeking the rest. They said that was all they were willing to offer. Should i go straight to moneyclaim or send a third letter seeking the £216 they owe me. Did stress to them that if it went to court Barclaycard would be liable to £216 + costs + 8% interest. No news on geting my defaults removed yet
  • HELP!!! We have got to the stage where on the 28th day Natwest have confirmed that they have entered a defence. The bank's solicitors has asked me to send them a list of all charges and reply within two weeks.

    The website states: 'Step 6: What if you still haven't won
    ........However in the rare event it does enter a defence, just do nothing. The next thing that will happen is that you will receive a Court Allocation Questionnaire - fill this in (very simple and very quick) and return it to the court (you must do so within 7 days of receiving it). Pay any additional fees at this point. Send a photocopy of the questionnaire to the bank - it is debatable whether you need to do this or not, but it's better to be safe than sorry over the price of a stamp. The court will now set a date (if the bank hasn't already given your money back by this point - and most will have done). Some (actually only one has ever got this far) might actually attempt to win in court - they may claim that the charges are for an extra service and therefore not a penalty, and thus legally enforceable. If this happens, come to the forum - we have this angle covered, it's slightly more complicated but worth it in the long run.'

    Should I reply to their solicitors or 'just do nothing'?

    As you have twice written to them, I would now go to Moneyclaim as the offer is less than half of what you are claiming. Do remember to put in that you are accepting the £144 in part payment.

    I wonder if someone could help with my query? I have a sole account and a joint account my sole account is O/D with no agreed limit and I've just paid the joint account O/D off. I have my salary going into my joint account and on reading above am worried that when my salary goes into my joint account they will use it to pay off O/D on sole account leaving me with no money to pay my mortgage. I am aware that they can transfer funds from sole account to sole account without your permission to pay off O/D's but can they if its going from joint to sole?? Does this make sense????!!

    Hi and morning all,

    Right i have numerous accounts with the abbey national

    1 current account with overdraft of £2170 but not upto its limit
    1 current account always in credit even if only a few £'s
    1 savings account usually under £200 in it
    2 childrens savings accounts about £150 in each

    The account that is overdrawn i have calculated that the charges due to me is approx £5000 give or take this is the account obviously that i want to claim on but none of the others. what i am concerned about is that they may ask me to close the other accounts. Can they do this. obviously i would be paying back the overdraft but want to keep the other current account.

    Before i proceed sending the initial letter i would like to make sure that they wont close all or most of my accounts..

    Its just a case of keeping an eye on here and seeing what people have posted or post in the future about Abbey... It would seem that abbey are getting a little closure happy... I think ususally its if you owe them something on an account that they get funny. Remember that you will be suing them and not many people like people doing that to them. Just keep it in mind, at least if they do go for closure they wont be asking for lots of money back from you.

    You only include the 8% interest when it gets to the moneyclaim stage, not before.
