    BOS offered me £157 as full and final payment.
    I was claimimg for £254.

    I was wondering if anything has changed recently that would suggest just taking the money (incase maybe they have found a new way to win in court etc?)

    I am fairly familiar with the procedure, and will go the distance if it's as near a sure thing as there can be.

    So, is it full steam ahaed with the "letter before court action"?

    Nothing has changed from what I can see, banks it seems are getting a bit tougher, ie. taking it to court but from what I have read nobody has lost yet. And with so many winners and no change in the law it will stay that way.

    Accept what you want, but you are owed more, I'd go the distance.

    afternoon all! I am sure I have read somewhere either on MSE or CAG that once the bank has given back your money that you can request they remove any defaults they have added against your credit rating - is this right:confused:
    First Direct have been very nice so far by replying v.quickly and saying they dont want any money for the DPA (false sense of security perhaps???!!:rolleyes: )

    I know this has been asked a million times before, but I want to get things straight in my head, before I contemplate doing anything.

    When living in London, I had an Overdraft limit put on my account. I went over this by £150 and was charged £80. The girl said had I gone in, she'd have increased my limit then I wouldn't have been charged. Anyway, I went over it a few more times throughout those few months and I think I was charged certainly a few hundred pounds in charges. Now, it was my own fault I went over the limit. It was also at a charge of £30 a pop - though I normally went over by more than this amount. They also charge monthly for a current account.

    The account is still open as it is still slightly in the red - however, I am within my limit now. It will also be paid off next month anyway.

    Anyway, bearing in mind I went over my limit by more than £30 a go and it was my own fault, am I able to have a go at reclaiming fees?

    just had an offer off hsbc.trouble is not for the amount i requested.
    what do i do now? do i need to send a court letter when i tell them i am not accepting their offer? please can someone tell me what i should do now as time is running out
  • Yes, send a letter saying you will accept what they offer in PART payment and will see them in court for the rest, it will work.

    can anyone send me an official letter template to reply to hsbc refusing their offer. i cant seem to open the link to get to the letters.
  • I've moved your posts in this thread pji2153 as if you look back through this thread a bit you'll find the letter you need to send.

    Either that or wait until Martin's new article tomorrow and the templates that will be included.

    The charges are the same if you go over by a penny or by £100, they are still disprortionate and therefore unenforceable. No one is trying to find out who's fault the charges are, just that they are illegal and therefore you can claim them back. Have a good read through the posts on here and check out CAG, and give it a go!
    Littlewoods catalogue - won back charges of £300 by default.

    What stage are you at? Have you already issued the court papers?

    I am running four cases for people at the moment, and with the first one, we have turned down three offers so far (£264, £1300, £1700). I have got copies of all the letters I've sent, so you may be able to use one of these.
