Claim back any unfair bank charges! Article Discussion Area

My partner has today received a response from his letter asking for the charges to be reimbursed to him, we used the letter template recommended and enclosed a detailed list of the charges and dates taken.
Here is a small section from the letter received;
" We have considered and responded to the Office of Fair Trading's statement of April 2006. We do not accept the Office of Fair Trading's findings in relation to credit card fees. We are concerned that the Office of Fair Trading has publicly called into question the setting of charges applied to other products, including current accounts. The Office of Fair Trading has restricted its investigation to credit cards and made no attempt to consult with RBS or the industry in relation to other, entirely different products.
Consequently, against that background, we must differ with the views expressed in your letter and will not be refunding any of the charges applied to your bank."
Has anyone else received a letter of this nature from Natwest? Do we now go striaght to small claims or do we send another letter?

received my data request from Lloyds after less than two weeks(Which suprised me) Charges total £2600. I've drafted a spreadsheet of all the unfair charges so it'll be posted tomorrow recorded delivery!!!
Also sending barclaycard the second letter, threatening legal action if they do not pay back £360 in charges and remove all defaults on my credit file!!

I sent the draft letter to the Abbey requesting 6 years statements and advising them of the legalities 3 weeks ago.
Today I've been to my bank and, although they haven't replied to my letter, they have put £250 in to my bank. I spoke to the Customer services operator who advised me that this was very unusual and not the normal way they would go about this but that it stated on the notes that it is a "Goodwill Gesture" after my complaint and that Abbey had refused my request to refund and hadn't requested any statements to be sent to me.
I am concerned now as surely they need to give me the opportunity to reject this "Goodwill gesture" and by them putting this straight in to my account does this mean I've accepted and agreed to no further action.
I am completely unsure what to do now. I know that the charges owed to me are well in to the thousands rather than hundreds though. Can anyone help?0 -
Go on with the next step and tell them you are only accepting the £250 in part payment of the charges you have claimed.0

My name is Mel. I have recently- Saturday just passed- found out about this illegal bank charges thing. My friend told me that the reclaim is up to 6 years ago...I haven't read this anywhere myself. Does anyone else know how far back the reclaim can go?
I only have the past 3 years' bank statements and so have no way of knowing- without requesting and paying a fortune for past bank statements- how much I have paid.
I did print off a letter from the internet and send it to my bank requesting they repay the unlawful charges applied to my account but I was unable to add any facts about my past charges to this.
Can anybody give me any advice on these points, please?! Thanks x0 -
If you are in England and Wales, its 6 years, 5 in Scotland. If you check out Martin's article you'll find a step by step guide and the first letter to them you should in fact ask for the charges information for the past 6 years and enclose a cheque for £10 for this information under Data Protection. They may not cash the cheque for the £10 but you don't need to pay any more than this.
