    Hi
Sorry if this is answered somewhere else already but I cannot find information about it so I'm hoping someone can help. I'm trying to calculate all charges I can claim back from my Lloyds TSB statements and there are lots of 'overdraft usage charges' applied. These vary from £5 to £25 in any month and I don't know if these can be claimed back or not.

I know I can claim for overdraft excess charges, interest on overdrafts,
and unpaid DDs, etc. but I'm really not sure about this fee.

    Can anyone advise please?
    Thank you.
    Hi
Yes you can, I claimed them on my successful claim.

I sent my letter, and cheque for £10 to the TSB on the 17th Oct and haven't had my list of charges yet. The cheque hasn't been cashed either.
  • They have 40 days to produce the information for you, also some banks are returning the cheque for £10 and not charging.

    LETTER BEFORE ACTION
    Section 7 – Data Protection Act 1998

    Dear Sir/Madam

    Account: xxxxxxxx

You have failed to comply with my Data Protection Act Subject Access Request dated (Insert Date).

If you do not comply within the next 7 days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice.

    Yours faithfully

You need to send the above letter to your bank, this is assuming the bank have sent you nothing.

thanks am posting now, assuming them cashing cheque was a good sign but who knows with the halifax
  • Make a Data Protection Act request to your bank. They have to provide you with the info going back as far as 6 yrs, and can charge a maximum of £10 for doing so, so don't let them give you any !!!!!! about £5 a statement or such like.

Make sure you ask for all available transactions and charges, as they'll try to say it took 2 people to intervene manually on your account every time they accepted/refused a transaction, and you therefore want them to show you where it says so on your file (they won't be able to ;) )

    Good luck.

    ML

Many thanks for that info bookworm 1363! :T
I've just received a letter from NatWest asking for £5 per 'historic' statement ... which would amount to something in the region of ... well ... several hundred pounds!

    Cheers

Well, I have finally gotten round to sending off a PDA letter to 1st direct but after reading that
    1) most people were having their £10 returned
    2) they can charge up to a maximum of £10

I have politely asked if they could provide me with a costing for the PDA up to a maximum of £10.00 and I will arrange payment...;)

I dont mind paying the £10 but at the moment cahoot are playing silly !!!!!!s and saying they cant send me a cheque book for a couple of weeks  so I thought I would test the water and get the ball rolling and see if 1st direct will do it for free! Will let you know the outcome...

Egg are playing more hard to get! :wall: Sent a message from online account on 27th Oct (which I can still access even though it is with DCA... ) asking for info. Received email back on 30th saying that my email had been forwarded to the relevant dept and someone would let me know... Yesterday still nothing so sent them another email which they replied to today saying of course we can send it out and we will charge you (I think) £2.00 per page (I say think because their £ signs appear as ?) sent back a message reminding them that as per DPA they can only charge a maximim of £10.00 and now awaiting reply although from what I have read on CAG it could take a while and a few clean pairs of knickers:eek: !!!!

From what I have read 1st Direct are quite good at sending info promptly and they tend to settle after you have said thanks but no thanks to 50%...:T fingers crossed
  • hello,

as anyone tried to claim charges back from intelligent finance?

also as anyone heard of natwest closing accounts?
  • i am in the process of threatening to take my bank to the small claims court for bank charges that have been debited from my account. These are not for going overdrawn, but the bank states that a charge is levied if your account balance does not exceed an average of £5000 during a given quarter.

Whilst looking at Step 6 on the Howto reclaim the charges bit of the website i noticed that it is stated that:

"(the bank) may claim that the charges are for an extra service and therefore not a penalty, and thus legally enforceable. If this happens, come to the forum - we have this angle covered..."

I believe that the principle applies to my case as the charges that have been levied against me are totally disproportionate to any costs the bank has incurred.

With the above in mind i would welcome the opportunity to discuss/be advised.

    many thanks

  • I have been fighting Natwest bank to claim my unfair bank charges for the past 4 months im claiming £3074.00 im at the stage now where they have appeared at court with me for a preliminary hearing asking for all the original bank statements and full reason/s why I think charges are unlawful (each and everyone)!! I nearly at the end of my tether!!!
But today had very good news that my friend has just got back £1500 full refund from the same bank!!
I think im the only person that natwest have taken this far!! God help me!!
WORD OF WARNING.... BE PERPARED TO FIGHT AS NATWEST WILL GO TO COURT!!!!
I'LL LET YOU ALL KNOW WHAT HAPPENS
