i am in the process of threatening to take my bank to the small claims court for bank charges that have been debited from my account. These are not for going overdrawn, but the bank states that a charge is levied if your account balance does not exceed an average of £5000 during a given quarter.

Whilst looking at Step 6 on the Howto reclaim the charges bit of the website i noticed that it is stated that:

"(the bank) may claim that the charges are for an extra service and therefore not a penalty, and thus legally enforceable. If this happens, come to the forum - we have this angle covered..."

I believe that the principle applies to my case as the charges that have been levied against me are totally disproportionate to any costs the bank has incurred.

With the above in mind i would welcome the opportunity to discuss/be advised.

    many thanks

  • HI THERE paul1912 here, I feel exactly the same im fighting with natwest and have been to court for preliminary hearing, the judge was so nice to me and was horrible to natwest solicitor!!, ps I have no solicitor either so don’t worry we'll get them!!!!!!!!! TSB and NATWEST are apparently (for larger amounts) they keep the intimidation going for as long as they legally can !!! So keep going your nearly there!! REMEMBER ITS YOUR MONEY !!!
    !!!
  • I went to court on 1st nov for first hearing, the judge was so helpfull and gave natwest hell !! i loved it. Natwest were asking for silly thing like origonal terms and condiction when i opened my account 15 years ago...i felt protected by the court well the know that the banks are trying so hard to worm out of all of this but LEGALLY cant!!! so now i have sent further information requested in the hearing today so im just waiting now.
dont worry you will get your money back, i'm claiming £3074 NATWEST and TSB take it all the way with high amounts and this is the end of the road now with both of us so just hang on!!!! :T :T

QUOTE=JerrynBrucie]Hi, have issued proceedings against Natwest Bank for unfair and unjust bank charges of £5000. Their Solicitors have served a defence and a "REQUEST FOR FURTHER INFORMATION & CLARIFICATION". I have to deal with this otherwise they will apply to the Court to strike out my claim. This is called a CPR Part 18. When I can work out what I am supposed to be doing hopefully the court will send out an Allocation Questionnaire so that we can have a court hearing date. Has anyone else experienced this kind of Request before. If so, how did you deal with this? Please help in anyway you can so that it will give me hope that there will be some light at the end of a very dark tunnel.[/QUOTE]

  • Quick answer is no, its £10 for all, tell him to send a cheque for £10 with the standard 1st letter and don't phone them.

Thank you so much for your speedy reply. Just starting process with natwest, rang them and they said they would charge me £5 which is fine by me. Scared about the whole court thing though :S :)

  • Just a bit of info, Lloyds TSB's solicitors, Sechiari, Clark & Mitchell (who have a phone line dedicated to this:rotfl: ) sent me a letter requesting that I acknowledge reciept of their Allocation Questionnaire, and asking for a copy of mine, which I didn't have. I phoned the court who said that I didn't need to supply them with this, so phoned S,C&M explaining that I had sent it to the court, but acknowledging reciept of theirs. They had no problem with this. Just itching to post my success in the other thread! They have actually ticked the box which says they wish for further action to be postponed for a month so that we can attempt to settle the claim.
