  • Best to read Martin's article here and look at the CAG forums and PenaltyCharges for templates for the letters you require and a step by step guide as to what to do. Have you accepted or refused the £85?
Thanks for your reply. I accepted the £85 not realising that my account had gone into red as a result of this charge! I received an extra £115 charge as a consequence of this.

I am trying to get back unfair bank charges from Lloyds TSB and the situation has gone further than I expected. I have followed the advice on this website and sent them the 3 letters from the Consumer Group website (1 asking for list of charges and 2 saying I was disgusted at their unfair charges and would take further action). I also sent them the spreadsheet with list of charges and they sent me a letter saying their charges are fair and to contact the Financial Ombudsman. I now have a court date in December (they put forward a defence to my claim) and they have a solicitor which I don't. I recently sent them and their solicitor a skeleton argument and bundle of documents as the court requested by 27 October but they did not do the same. I faxed the court to inform them of this. After that I received another letter from the bank saying that they could not add further to their previous response and their answer was still no and to complain to the Financial Ombudsman. I have now completed the complaint form to them and will post it tomorrow. I am getting extremely exasperated with this, especiialy as I know other people who have been successful after just sending their banks 1 letter (and I told them about this in the first place). Does anyone have any advice for me or words of reassurance? I have heard that no one from the bank ever turns up in court and it would make legal history if they did. Is this true?

    Hi
From my experience Lloyds TSB are one of the worst banks for claiming your money back. I recently got over £1500 back from them, I received a Court date and they settled approx. 3 weeks before this date. Have a read of all the success stories on the CAG website, that should give you some inspiration! You will get your money back, but LTSB will drag it out for you, hoping you will give in.
    Good Luck!

thanks for this, i do know about the account, i know what the account was for, when it was taken out, when it was closed and all of my contact details for that time, i simply no longer have the specific account number as i didn't envisage this situation arising, from my rough calculations i am owed thousands so i would naturally like to pursue this line of enquiry. As i said, thanks again for your reply

If you have all that information, you should therefore be able to get the account number etc from the company. Good luck!

  • Hi, have issued proceedings against Natwest Bank for unfair and unjust bank charges of £5000. Their Solicitors have served a defence and a "REQUEST FOR FURTHER INFORMATION & CLARIFICATION". I have to deal with this otherwise they will apply to the Court to strike out my claim. This is called a CPR Part 18. When I can work out what I am supposed to be doing hopefully the court will send out an Allocation Questionnaire so that we can have a court hearing date. Has anyone else experienced this kind of Request before. If so, how did you deal with this? Please help in anyway you can so that it will give me hope that there will be some light at the end of a very dark tunnel.
  • Your best bet is probably to look on the CAG Forums for the board for NatWest and see how other people have got on with their claim.
  • Firstly the amount is not much but I want to get the money back from them anyway. It's the principle and my wife and I need the money!

The charges have amounted to about £65 (some amounts of £5 for not paying money into the account and one for £25 for going over drawn)

Anyway I joined Alliance and Leicester to get the incentive (£50 I think). I paid in my wages, got the incentive and convinced my wife to also join so we would benefit again from another incentive. Unfortunately she didn't keep an eye on the account, so recently got a snotty letter stating that she is overdrawn and will get a large fee.

Basically she put some money in, got the incentive then left the balance a ZERO for a few months. Every now and again they charged £5 for not using it, then recently £25 for being over drawn.

The fact that I have the same type of account and have not used it for ages and have not been charged at all is just weird.

Also she was not informed about the £5 charges at all.

Do you think we could get this back? She has rung and they said tough, because she has broken the contract she signed.

    Any help would be good,

    Many thanks.

    Hi
Sorry if this is answered somewhere else already but I cannot find information about it so I'm hoping someone can help. I'm trying to calculate all charges I can claim back from my Lloyds TSB statements and there are lots of 'overdraft usage charges' applied. These vary from £5 to £25 in any month and I don't know if these can be claimed back or not.

I know I can claim for overdraft excess charges, interest on overdrafts,
and unpaid DDs, etc. but I'm really not sure about this fee.

    Can anyone advise please?
    Thank you.
  • Hi to all
First time in using the message board facility on this site!

I wonder if anyone can offer any advice to me please?

I have a basic account with my husband (he's had previous credit problems, Defaults & CCJ's) in one of the major high street banks where all our DD's/SO etc come out as well as it being our main account.

Last month, we saw that, because of my husband's work he was not going to be paid in October (he's self employed) and I wrote to the customer relations dept of the bank and to our branch to advise them BEFORE anything happened. I receive a letter back stating that they thanked us for informing them and the appropriate dept in the bank had been informed. We thought that the bank would have sympathy with us as we had previously kept the account in good order.

Unfortunately, the letters started coming from the companies whom we had direct debit agreements with, stating that they had been 'refered to payer' but NO correspondance from the bank stating they had rejected the DD's.

We wrote another letter that has yet to be answered complaining about the charges.

On 30 Oct we had a phone call from the bank stating we were overdrawn without authorisation and what did we intend to do about it. I explained that we were broke, so much so we couldn't buy food for ourselves and we had literally 30p to our names. The bank then said they'd agree a £300 overdraft for 30 days and that within 48 hours this would be in place so we could, in their words 'stop incurring charges and buy food'.

The overdraft was not actioned and further charges incurred. Telephoned them today but apparently their systems were down so no-one could help.

I am really upset because we have almost £420 in charges which means that from what my husband will get paid, we won't be able to cover the mortgage and other bills and this situation will just escalate as we'll be in the same position next month.

My husband is ringing the bank up tomorrow and I just want an idea of how to get an immediate refund, we can't afford this at all and I feel we acted properly in letting them know we were in difficulties yet they haven't listened at all and have no sympathy.

I've tried the letter on the main page but it's fallen on deaf ears.

    Thank you all.

Your account reads identical to article I read from the BBC. She was a reporter and it was her had problems because she had a baby. I'm sorry I can't find the link right now but I would suggest having a quick search, just something I thought you could relate to and hopefully get a few hints
