Polo01, yes you can claim charges for going over your authorised overdraft.
  • the bank has to reply within or by 40 days of receipt of your letter not working days.

Tinks here, no I am not promoting the website, and i know that you can do it on here, but i just don't have the time to do it myself, and I am admittidly a little lazy, so I have got someone to do it for me, hopefully it will work, will let you know how it goes, either way i have lost nothing because i didn't realise that i could do this...
    Tinks xx

Following on from your comments, I've just checked out this two bit, knocked together in five minutes website. How very dodgy, no real contact address, rubbish

What tinks72 has said has rung true with many I guess and that you have to spend time following these charges up, but honestly I have Barclays sending me £500 through the post and have just issued Lloyds to pay £3k through the small claims. And it has taken a total of 3 man hours max. This company would want to take hundreds from me.... Pft!!

I would also like to say whilst this link tinks posted should be left alone, its a good sign to see that lots of ambulance chasers are cropping up, means that people are having success

Question: Are we aware of anyone not getting their full payment when taking the banks to the small claims?

Hi, Just received statement from lloyds to show charges over last 6 years,It shows overdraft charges for going over the overdraft and unpaind direct debits due to these charges, Can I claim these back?

Statement also shows monthly interest account charges and overdraft interest are these charges that can be claimed or not?.

Would appreciate some advice before sending request for refund to bank.

polo01 yes you can claim back your charges plus interest on them, this is basically on the premise that £30 is too much to charge.

I doubt you can claim back interest charges though, I've not heard anyone doing but it is up to you.

You add the interest on when you put your claim into Court. Most people claim 8%, thats what my daughter got, but some are now compounding the interest - I think some have got it. There are some huge claims going through at the moment - and the banks still have not disclosed there actual costs.

Hi. Ok, furndire is correct on the interest on charges that you will charge the bank for keeping your money. What you are asking (I think) is can you claim back the interest that they have cherged you for the time spent over your overdraft limit? If you look back along this thread there are some good posts on this matter. Essentially yes you can claim it back, but it is very hard to extract the interest charged on the charges alone from that charged on your normal overdraft, i.e. what you have actually spent. If you can do this and you are confident that you are ONLY claiming the interest back on and overdraft fully made up of charges, then you are OK.

The very letters you need are located on the CAG website, and probably others too. Send them the non compliance letter, then follow the track you feel most suits your case.

    Account: xxxxxxxx

You have failed to comply with my Data Protection Act Subject Access Request dated (Insert Date).

If you do not comply within the next 7 days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice.

You need to send the above letter to your bank, this is assuming the bank have sent you nothing.
