    LyndsayJ, are you England and Wales or Scotland as you can only go back 5 years in Scotland not the 6 years you can in England and Wales.

    My finances started going very badly around 2001, i sold my house as a result of the charges and so forth. In short i currently have unsecured debt amounting to £22,000. I am in voluntary agreement with all creditors. Can i claim for charges even though the accounts have been closed, such as the old mortgage i had or due to consolidation? and for the rest of the creditors which have sent my account to external debt collection agencys?

    A large proportion of my debt is with Intelligent Finance, i couldn't see them listed on the site- as anyone pursued them for the charges?
  • whoops, sorry just read the above reply, great stuff,but with some of the accounts like the old mortgage account i no longer have the account details, can i still pursue a claim against them?

    Am in Colchester, England... so you think I can then? Don't seem to be many people following it through for such small amounts, am wondering if it's worth it but could really use that money just now!

    I claimed for about £250, took it all the way to moneyclaim. Its your money!

    You cant claim for an account you dont know anything about, you will need to contact the company/ies to get your old account details. Otherwise how can you know the charges, and what would you are claiming for?!
    Littlewoods catalogue - won back charges of £300 by default.

    thanks for this, i do know about the account, i know what the account was for, when it was taken out, when it was closed and all of my contact details for that time, i simply no longer have the specific account number as i didn't envisage this situation arising, from my rough calculations i am owed thousands so i would naturally like to pursue this line of enquiry. As i said, thanks again for your reply
  • I am trying to get back unfair bank charges from Lloyds TSB and the situation has gone further than I expected. I have followed the advice on this website and sent them the 3 letters from the Consumer Group website (1 asking for list of charges and 2 saying I was disgusted at their unfair charges and would take further action). I also sent them the spreadsheet with list of charges and they sent me a letter saying their charges are fair and to contact the Financial Ombudsman. I now have a court date in December (they put forward a defence to my claim) and they have a solicitor which I don't. I recently sent them and their solicitor a skeleton argument and bundle of documents as the court requested by 27 October but they did not do the same. I faxed the court to inform them of this. After that I received another letter from the bank saying that they could not add further to their previous response and their answer was still no and to complain to the Financial Ombudsman. I have now completed the complaint form to them and will post it tomorrow. I am getting extremely exasperated with this, especiialy as I know other people who have been successful after just sending their banks 1 letter (and I told them about this in the first place). Does anyone have any advice for me or words of reassurance? I have heard that no one from the bank ever turns up in court and it would make legal history if they did. Is this true?

    Does the DPA payment have to be a cheque and if it does, does the cheque have to be in your name?!?! am about to fall out with Cahoot in a major way!!! sent a request for a cheque book last week and just received an email stating that this option wasnt activated on my account so been and activated it only to be told it will be sent within 5 days of next statement date which isnt til 14/11 so I wont receive c book til about 21st... :mad: I dont want to be waiting that long! I want to get the ball rolling now! I already have my letters typed and waiting - would I be able to use another form of payment of would a friend be able to write the cheque?
  • not sure that I am right, but i do not have cheque books, so i have sent postal orders instead, surely these must be acceptable?. I have also sent mine by recorded delivery so they cannot deny receiving them!
