    I was wondering if you peeps could help me as I am unsure of which letter I am supposed to be sending next.

    Basically I have recieved all my statements and sent off the prelimanary letter with a list of alll charges attached. They sent me a letter offering me £80 out of £366. This reply was sent back to me within the 14 day deadline, so which letter will I be sending next? I am obviously going to reject their offer, but is there a template which i should be using from the CAG forums?

  • I have sent off the letter template to two banks - Halifax and First Direct.
    Halifax have written back to me offering me a goodwill gesture payment which is 25% of the figure I have claimed.
    I am doing my response saying get lost, I want it all - but the template on Consumer Action Group has the response for if the bank has literally ignored my letter - what would a suitable follow up letter be that outlines that the offer is not accepted and a full repayment is necessary or court action will ensue? I don't want to rile them with rudeness in my letter...
    Any suggestions welcome

    Try this...

    I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £XXXX

    I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary.

    My letter before action sent previously indicates that you have until XX/XX/20XX to respond before Court action commences. You are reminded that there will be no extension to this timescale.

    Assuming you have read Martin's article, you need to send each bank the first letter enclosing a cheque for £10 to each asking for all information on charges etc for the past 6 years, 5 in Scotland, under the Data Protection and give them 40 days to respond to you.

    Hello

    I'm currently part way through a claim with the Halifax for £819 (refused first offer, they've got until next Friday to pay up or I'll have to do the next step - eek!).

    I thought I'd have a look at my HSBC statements (been closed for about a year). They sent them out free of charge. There's about £190 of charges on there.

    Is the procedure the same, or is there a different letter I should send? :confused:

  • Hi i'm about to put in my first claim to natwest. (credit card to follow)
    my question is where do people send they're first letters? is it to the branch where my account is in hull or is it to the main registered address in london?
  • I think it would be the same but my husband had to detail every charge to HSBC on one of his closed accounts, he sent one letter first without detailing the dates and amounts and they sadi that he'd have to proivde more detail before they'd consider a claim. They paid up in full within 28 days.

    It would be worth sending a letter to your Natwest branch and also a copy of the letter plus a cover letter to their customer relations. Branches apparently have to respond within 24 hours.

  • My husband and I are botha bout to send away Subject access request to Abbey and RBS. As Ihad a current account and credit card with Abbey and my husband had a current account and creit card with RBS is it ok to send a single letter and one cheque for £10 to each bank?
