The main difference to start with is you can only claim back 5 years instead of 6 years in England and Wales. Then if/when it gets to applying to the court it also is different but as Helen says check out the Scottish Procedure section on CAG and follow the instructions there.0 -

I have issued a MCOL against BOS (mortgages) for unfair bank charges, they acknowledged it and have now entered a defence. I am quite prepared to see them in court and am looking forward to receiving the allocation questionnaire but would like to know is this what others have found to be normal practice for BOS? Do they push it to the limit just to see if you are really, really serious about taking them to Court (which I am most certainly am)? Any experience others have had with BOS would be useful to me, I would like to understand a bit more on how they operate. I am quite prepared to see them in Court though I am sure realistically it will cost them a lot more than the £462 I am claiming to defend their claim in court.

Hi i have wrote the prelimary letter with my schedule of claim for charges but who do actaully address the letter to??
also should i send recorded delivery,

Send it to the head office and I would at least get a receipt of posting if not recorded delivery.0

I would like to know how i go about letting the bank know i am not accepting their offer.£1450 less than i am owed.
do i need to send a small claims court letter or can i just write and tell them?
I would also like to know when the banks eventually pays out can i request a cheque payment as i do not want to use hsbc again .0 -
hi .. i have sent the letter off to abbey national asking for a list of all my charges ..... but this morning i received a letter from them saying 'you may already know that your overdraft of £900 is due to expire on 1st january 2007'
it goes on .... i'm sorry to tell you,we are not able to renew the same overdraft amount .but we are able to offer £550. we need to reduce this onthe expiry date ,so make sure make sure your account is in its new limit.if it is not you will be charged . you should also know that you'll have to pay your overdraft back immediately ,if we ask you too .

this is a direct result of me sending the letter to them asking for details of all charges . i am not sure what to do now as worried if i push it they will require the overdraft to be paid off straight away which we couldn't do . we also have another account with them with £1000 overdraft on which is our main account ,which is also upto the limit everymonth .
as i was worried they might threaten to close the accounts i opened a new account with a&l and thats all been accepeted and a&l also given us c/c ..
but i am in a pickle about the overdrafts .. a&l only offered us £550o/d and when i rang to say about the matching my existing o/d they just said untill you make the switching process they wouldn't be able to comfrim if they could actually match our existing o/d amount ? .. also we have to provide statements showing we have been in credit ....which we can do but only for a couple of days of the month ... and i'm worried they will look at the rest of the month and see we are always up to the max on the overdraft .
please please can anyone help me with some advise ?
is this worth it .. i worked out for the last 3 years we have roughly about £400. in charges .. but can't check back any further as i threw all the statements away that were older then 3years old ! Doh!
we were working on paying back to 2nd account o/d with our tax credits which was £235per month .. these have stopped now as they say we owe them money ..i am not working as added on to my maternity leave another year to look after our 3kids but i am returning in march ..the only money paid to the 2nd account is the child benefit money of £163. the main account is where everything happens . should we consider a loan to pay both overdrafts off or what?0 -

send them a letter asking for the full amount, or you will sue them.
sue them if they refuse0
