Hi, this is my first post(be gentle!) although i've been reading these posts for a while.

I am in the process of claiming back 6 years worth of charges from the Bank of Scotland. I have calculated I am due £1,858.00. Now I understand from reading stuff on the Bank Action Group that the process is slightly different should this go to court. The site does refer you to different sites but to be honest, I can't really understand them!! Could anyone help clarify the differences that exist in Scottish courts should it come to this.

At the moment I am just about to send a letter asking for this money back..everythings crossed!!

Thanks in advance for any help!!
I'm unable to advise you on this and see no one has been able to answer in here up to now . If you ask in BAG someone will be able to answer you.
Wish I could stop editing EVERY post I make

If that was in reply to your letter before action then when the deadline you gave them is up put in a claim to be served at YOUR BRANCH.

No, the letter was in responce to the first letter and not the letter before action.
Do I now send them the letter before action?

That's the correct letter to send yes. Regarding the interest, just delete that part.

You ONLY Show for the interest if you make a claim through the courts and for that, there is a spreadsheet link further down the template section.

    Hope that helps.

You give them 14 day's which is stated on the bottom of the letter.
With my letter I enclosed a Spreadsheet (List) of all the dates, amounts and there description for there ease of reference.

Cheers, i will just do that myself.

    :)
Done the letter and made a list of Charges, Dtes and reasons for them... wow!
Before i have them sent can someone confirm to me 2 things..What it means by asking for them to reply accepting unconditionally. And what is a letter before action?

Sending on Saturday 08 April.14 days from that for reply is 21 April. No reply to that or one not positive (ie saying No way matey)then send a letter before action, giving a further 14 days from date thats sent...

I sent the DPA request to Intelligent Finance about a week ago, enclosing a £10 cheque, and have just had a phone call saying that they do not consider account transactions as "personal data" so I did not need to make a DPA request.

The person asked why I wanted the information - I was vague - and said that "on this occasion" she would send a summary of charges; otherwise I would need to ask for duplicate statements, for which there would be a charge!

Do I need to know the dates and precise nature of charges made in order to reclaim them? And does anyone have any experience of doing this with IF? I really want to get them as we closed the account due to the ridiculous charges made!

    TIA,
    Mel.
