No the can't the other accounts are not related to his current account; they exist independantly, the only account they can close as a result of this claim is his current account.

Thanks so much! That's a big relief. If anyone has a different opinion or knowledge I'd be glad to hear it. OH is really nervous about the consequences of proceeding with this when we have other accounts with this bank. :o

No - that is not true.

If you read the small print on ALL T&C's from banks (about current accounts in particular) it says "We can close your account without reason after giving you 30 days notice).

    Or words to that effect.

IMHO, they would be biting their nose off to spite their face, but banks, of late, have not been known for good business sense, so I would proceed with caution.

Thanks. I guess the whole thing wouldn't count against the mortgage account though....? I think I need to dig out some paperwork and read the print very carefully.

Speaking of which, anyone had any experience with the Halifax? Are they prone to closing accounts when you try to claim back your money? Also, do other banks get fussy about giving you a new account if your old bank has closed one down? Or is having the safeguard just to make sure you don't have any period where you do not have a bank account?

    Sorry for all the questions!

What happens when your bank sends you the first letter back saying that it is stipulated in the T&C that these are the charges.

I live in Scotland and my local bank is the Royal Bank of Scotland. Can I still fill out the form for Money Claim??

Due nearly £250....could do with it soon :)

If you don't ask, you don't find out!

Sorry about that, I thought that as the other accounts had nothing to do with that account and they were in both names the bank would have no reason to close them! My mistake dchurch is the expert.

Has anyone seen that the OFT have just released a statement saying that charges are exessive. they are saying that charges should be no more than £12 and even that may be too high. they expect card companies and banks to now review their systems

    They are stalling.

Did you send a DPA request? If so, (and even if not in this case) they are in breach of the Data Protection Act - they have lost your data.

Report them to the IC immediatly.

Well I read through the leaflet regarding reporting them to the IC. They require copies of correspondence to back this up. So I rang the call centre again, they said I needed to go through the branch in order to receive a letter confirming what they told me.

So I rang the branch and a (very helpful) lady told me she was going to send me a FORM they have which I need to complete in order for them to trace my account details! So they were stalling, and completely talking out of their !!!!!!! The form is in the post to me today, I need to complete as much as I can, send it to an address (she's marking the one of the form I need to send it to so it goes straight there and I don't have any more hold ups), and then they will trace the account number!

I have to admit to being shocked that someone lied to me outright about being able to trace my account!

I got another letter from hsbc this morning - the standard 'we do not think the charges are unlawful ......hope this is the end of the matter blah blah'

in the letter i sent them i said 14 days to respond before i applied to the small claims court - i take it its ok to go to the court now as ive had the response (ie i still dont need to wait until the 14 days are up incase they comeback with something else??)
