    Always stick to the time limits you have given them, this shows the courts that you have been reasonable throughout.At the end of your 14 days start your claim.You would be best in the mean time to read up on making a claim even have your claim prepared in ' moneyclaim' just don't submit it until ......

    Anyone from scotland having problems claiming money back from thier bank using the MoneyClaim website, apparently the address for 'serviceing' needs to be in England or Wales!!

    If you don't ask, you don't find out!

    I have been charged £80 by Nationwide. Not worth going to Court over but they would not reply to my letters so in frustration I gave them 14 days to reply or I would sue them, they did not reply in the time given so I lodged a claim on line - very quick and simple. They did not lodge a defence so I have applied for judgement, again very simple. I was motivated by frustration and indignation rather than the money but having seen how easy it is even if the charges are quite small it is worth claiming. The Court process is actually the easy bit compared with the writing and posting of letters that you have to do first.

    Hi, this is my first post(be gentle!) although i've been reading these posts for a while.

    I am in the process of claiming back 6 years worth of charges from the Bank of Scotland. I have calculated I am due £1,858.00. Now I understand from reading stuff on the Bank Action Group that the process is slightly different should this go to court. The site does refer you to different sites but to be honest, I can't really understand them!! Could anyone help clarify the differences that exist in Scottish courts should it come to this.

    At the moment I am just about to send a letter asking for this money back..everythings crossed!!

    im in the process of claiming back bank charges from over the last 6 years (from my time as a student). I received the bank statements i requested under the dpa, but one load of statements begins with:

    29th Sept 2004 Account Renewed (balance)

    I remember getting a letter about this at the time saying that this was happening, but of course i was unaware of the concequences. It seems that the bank has just wiped out my account before this date.

    Is there any way of getting this data (i reckon there are around £300-£400 of charges before this date)? If not, then how does this affect my claim? Can i assume anything about the charges (which i doubt i can)?

    At my work, we have to keep records for the last 7 years, so surely you would think that the bank (the wonderful Halifax) would have to do the same.


    Also, on another point, i used the letter downloaded from this site to claim my records under the dpa, but in the response the man from the halifax said

    "turning to your request for a list of all occasions where there has been manual intervention on your account... an investigation of this kind would involve a disproportionate effort and HBOS is not legally obliged to supply this info".

    I dont really know what manual interventions are, but surely under the dpa, they have to tell me everything. Are the bank right in what they say, or should i complain about this answer.

    Any help on these queries would be greatly appreciated, as we're all trying to get whats fair for us.

    Hi I'm hoping someone can answer a question for me.

    I recieved a lot of bank charges from Natwest when I was struggling with debt a few years back. They called me into the bank and I explained I had been made redundant and was trying to make a living working freelance and had developed some serious debt issues. They said I could no longer have an overdraft with them and sold me a pretty high interest loan to cover the outstanding amount.

    By signing up for the loan have I perhaps scuppered my chances of making a claim back for my bank charges?

    This is the reply I got from Natwest after sending the letter out to claim back the charges, ANY SUGGESTION ON THE SECOND LETTER?

    Thank you for your recent letter and I apologise for any dissatisfaction caused by the application of charges to your account.

    We believe that our charges are fair, reasonable and transparent. We consider that the amounts debited to your account have been applied strictly in accordance with your agreement with us and our published tariff, which we are satisfied complies with all applicable laws and regulations. We are also committed to ensuring the transparency of the information that we give to our customers about the operation of our products.

    Against that background, we must differ to the views expressed in your letter. Accordingly, the charges that have been applied to your account must stand.

    I am disappointed to note that you are contemplating legal action against the bank. Whilst I hope you will feel able to reconsider, should you decide to go ahead, please ensure that and proceeding are served on our Registered Office address, which appears on the foot of this letter.

    However, thank you again for taking the trouble to write.

    If that was in reply to your letter before action then when the deadline you gave them is up put in a claim to be served at YOUR BRANCH.

    NO , start making steps to claim back your charges for the past 6 years

    write back telling them the data they supplied is incomplete and tell them how many days they have left ,to date ,to supply it to you or you will be reporting them to the information commissioner.
