Here's my OH story..He's crap with money and having checked back on his statements for 6 years..Have found total charges for £3000. Also this month, he is in the black but is still getting charges for rejected payments???

So sent off the first letter to bank and got a 50/50 offer....sent the second letter and got a 'no way' letter.....Now tomorrow going to file a court case using the online system!!

Really worried that I am now out of my depth....What if he has to go to court???

    Help!!!!

can someone confirm to me 2 things..What it means by asking for them to reply accepting unconditionally. And what is a letter before action?

Sending on Saturday 08 April.14 days from that for reply is 21 April. No reply to that or one not positive (ie saying No way matey)then send a letter before action, giving a further 14 days from date thats sent...

I know its perhaps the most obvious thing but not to me sorry.

Do you believe that you have a legal right to the money?

If yes, then if he goes to court, you should believe that he will win.

I believe it, and with the OFT announcement last week, it's almost inconceivable that a judge would rule in the banks favour.

I've started my plan to get back charges from Alliance & Leicester giro, all I've done so far is write to them asking for details. I've received a reply asking for £10 for them to release this information, does anyone know if this is acceptable? I've tried to go to the bank action group website to find out, but it's been unavailable for 5 days now

Which is the address you are using?

If you go to https://www.bankactiongroup.co.uk (or.com) then click the 'forum' link, you should be fine.

    The site hasn't been down.

I went onto the bank action group because the same thing happened to me, A&L asked me for £10 for details of charges. On the bank action group it said that it will cost you £10, so I assumed from this that it was ok to pay it and I sent the £10 cheque off. This was last week and I have yet to receive the information.

They can charge a max of £10 under the DPA.

Don't be nervous - it's they that should be nervous - you haven't done anything wrong.
