  • Hi!

    Firstly... fantastic site! :T

Bank account with Halifax. Reclaiming unfair bank charges.

So far.... asked for my last 6 years statements and received them about a week later with a letter saying they would normally charge £5 but have not this time! Sent off my request for payment of charges (24th March) which i worked out to be just over £2200. Received a letter about a week later saying they are sorry I am not happy and my case has been sent to another department who will be in touch very soon??

But..... I have just been entering the charges onto the excel spreadsheet (in preparation) and realised £500 of the account charges information sheets they sent me are duplicated, so they only owe me £1700. What are my options??? Leave it to see what happens or write again saying I got my figures wrong???

    PLEASE HELP?!?!?!????

Wondered if anyone can help, have joined the Bank Action group (registered and received the activation email etc) but it still will not let me log in! I am desperate to find the template for the letter asking for bank statements from my bank (as I received another whopping £39 charge today), but am unable to log in. I have emailed the webmaster but have not received a reply. Can anyone help? Is it possible to download the template from anywhere else?
sorry if this is in the wrong place, as I havent posted here before!
    thanks

    Here you are:
    [your address]

    [their address]

    [DATE]

    Data Protection Act disclosure request

    Dear Sir/Madam

    ACCOUNT NUMBER: xxxxxxxxx

Please supply me with a complete list of transactions and charges relating to my bank account since [xxDate as far back as you wantxx]. Alternatively a complete set of bank statements for that period will be acceptable.

Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my banking busines with you.

If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.

I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me then I shall be reclaiming them and also reclaiming the enclosed £10 DPA disclosure fee.

    Yours faithfully,

Don't be scared, no need to be. :)
    Think Positive.
  • After previously speaking to my bank... or rather the call centre the calls get forwarded to when the branch can't answer the phone.... who informed me that they can trace my bank account number (that I closed 3 years ago) with the address, name and date of birth. I was yesterday informed that they can't. I rang the branch, got through this time, and chased a response to my letter, they said they can't trace the account and put me through to a regional call centre, they told me they couldn't and apparently they checked with dormant and closed accounts and they confirmed that they can't trace it either. Is this correct or are they just being difficult?

Does anyone have any views or advice on this?

So if OH proceeds with claiming for charges against his current account, can Halifax threaten to close down the joint account and/or do something sinister with the mortgage?

    Advice greatly appreciated.
    Thanks

No the can't the other accounts are not related to his current account; they exist independantly, the only account they can close as a result of this claim is his current account.

    COMPLAINT
Your Reply Letter Reference Number: ********

    Dear Sir or Madam,

    My first response to you:
“Upon applying for the loan online and being accepted I have noticed that it is a Protected Loan. I did not want and did not choose to have PPI on the loan. I have been advised that I should therefore be able to cancel the PPI contract at any time and receive a partial refund of the premium that I have paid. In view of the way I was mis-sold the insurance, I would also like to ask for a full refund of the whole premium.

I would appreciate a reply to this letter within fourteen days. If you reject this complaint, I would be grateful if you could explain whether you provide an internal appeals process. If you do not, please supply me with a final response letter, so that I can take up the matter with the Financial Ombudsman Service.”

The response I received from you:
    ‘Please see Copy Attached’

    What I require:
I require Full reimbursement of my PPI.

My targets to resolve this matter:
After receiving your letter reply, I am not happy with your response. I believe I was mis-sold the PPI on the grounds that I never asked for it when I applied online. I have had previous loans with you and I know about the Terms & Conditions regarding the “30 days no cost to cancel” the loan.
This is where I believe the legal mis-selling comes into it. I was under the impression that there was no PPI on the Contract as I specifically did not ask for it online. As a result of needing the loan to go through as quickly as possible, I signed and returned the contract under the impression I was paying back just the loan. It was only recently that I realised that it had PPI on the loan after accessing it through the internet banking service.
I would like the PPI cancelled from here on and on top of that a full refund.
If this does not happen, I will be sending a final letter to Barclays allowing you 14 day’s in which to reflect upon your decision before starting legal proceeding’s.

    Yours faithfully,

    They are stalling.

Did you send a DPA request? If so, (and even if not in this case) they are in breach of the Data Protection Act - they have lost your data.

Report them to the IC immediatly.
