    My opinion is you have signed for it , no matter what the reasons ,so you agreed to it .I can't see how you can now go and ask for it all back .

  • my bank (abbey) is trying to charge me a total of £50 for going 27p overdrawn!!! :shocked:
    £20 for going overdrawn & £30 for them making the payment(which was for £1.50) :mad: :mad:
    they had no even told me i was overdrawn,untill i got statement today with a list of charges!!!
    luckily for them i am too ill today to be going into the branch and going mad, and kids off school due to strike :(
    i will be going in tommorrow, so i would like some advice please as what to say instead of just getting v.cross.thanks

    thanks for reply - i thought they would be legal lol - have checked all accounts and there arent any other charges as ive never gone over the agreed overdraft - i did receive a pm saying i could ask for these charges back, but, to tell you the truth i darent because i have a £2000 overdraft and im just at that now - i couldnt afford to pay it back in one go if they close the account.............thanks

    I've found this so incredibly interesting that I have decided to attempt to get all of my charges back. I've been paying fees from my bank for about 12/14 years now, you know the scene, go 10p over your overdraft and be charged £35, so the following month you are short of cash again, pay the gas bill and go £1.25 over and get charged again. Anyway, this has gone on for as long as I remember so I've closed down a savings account I had elsewhere and put all of the cash into my current account hereby clearing my overdraft (so if they close my account I am don't have a huge overdraft to payback). I've opened a sparkly new online account with SMILE ready just incase they close my account and I need somewhere for my wages to go and I've started the claim process.

    I also found out the name of my branch manager and all post is being sent special delivery for HIS PERSONAL ATTENTION.

    All of the standard letters attached to the main article are great, basically I've copied and pasted them onto my own letter headed paper on my PC. I wrote yesterday to my bank asking for a list of ALL OF THE CHARGES MADE ON MY ACCOUNT AND THAT I UNDERSTAND ACCORDING TO THE DATA PROTECTION ACT I AM ENTITLED TO THIS INFORMATION. I WANT DATES, REASONS AND VALUES.

    When this comes back to me off goes the first standard letter, 14 days later goes the second stadard letter etc until I have my funds back. Its also worth them asking that they correspond with you on a personal basis and not bombard you with leaflets and standard print.

    It's a shame you can only claim the last SIX YEARS worth, as I say, this has gone on for 12/14 for me and it must be THOUSANDS. I'll let you know how I get on. Watch out NatWest! I am so excited about this.

    Richard , make sure they know your asking for it under a DATA PROTECTION DISCLOSURE REQUEST also ask them for any MAUAL INTERVENTION NOTES ..and make sure you enclose the £10 , remind them they have 40 days to comply.... if you ask for more then £5000 you are at risk so you must sever it.

    Rang the bank again today and the chap who initially was sending the statements out, done something wrong and they have never been ordered! Spoke to a lady today who will have them ordered and sent out first class tomorrow...I dont hold my breathe tho!

    I send my letter of DPA off back in March, they have till Mid April...But...I've not even recieved a letter for the £10 or that they are looking into it.

    After the 40 days are up, Do I sent another one out with 40 day's again?

    hi all. just an update on my quest...

    received letter from lloyds this morning from the service recovery branch in brighton. basically said the usual ' you knew the terms and conditions when signing up blah blah' then went on to say that they apologise if i 'got the impression' that their staff were being unsympathetic.

    They went on to say my claim for a refund is not justified or supported by the events that prompted me to write BUT ...

    they are prepared to waive the £23.29 interest incurred since november 2005 and refund £168.00 which is the Select fee incurred on my account since referral to the collections department on the condition that I downgrade my account. (shows how much they know, as i did this about a year ago!)

    have enclosed an acceptance form for signing and then close by saying 'i hope i have been able to fully answer the points you raised with us, if not please let me know what else i can do to help'

    that was signed by Daniel Burton (senior advisor for the service recovery centre)

    am still filing my claim today . bit more hopeful now!

    you shouldnt give the bank any more time. did you send your original letter by recorded delivery?

    i have been advised to stick to the time limits i originally gave. so if you promised action after a certain period, you must stick with it.

    that said, i had no answer for about 2 weeks after sending in my first letter, then have had both the statements and 4 letters all within the last 10 days.
