I believe it is the same, although it's worth checking the limit on 'small claims' and also I expect the procedure will be different to that of the UK.
Try phoning MoneyClaim.gov.uk - they're very helpful.0 -
I Bank with The Clydesdale bank and have just started the process by asking for the data under the data protection act.. Due to the way the letter is worded about "I will accept bank statements as acceptable form for this... etc" They took over £350 pounds from my account @ £5.00 per statement!!!! Needless to say I was on them so fast they were in a real tizzy when I demanded the charge back. ! ( they are permitted to charge a reasonable amount for the provision of the data IE £10 or so.) The charge is now back in my account.... and I will be submitting a request for alll my charges going back five years which amounts to around three thousand pounds. I,m so angry ....WATCH THIS SPACE!0

Can you claim charges back from the Student Loans company?
Does this proceedure also apply to Business Bank Accounts?

you can claim back from anyone who has charged you a penalty eg shops own cards .You will find more information at https://www.consumeractiongroup.co.uk people are starting to claim back unlawful charges from many places as you will see on that site.Wish I could stop editing EVERY post I make :mad:0 -

I think the problem sometimes with this is people are asking for their statements ( not saying you did ) not for a list of charges but saying you will accept statements , it's all in the wording.Sometimes people are also not pointing out it's a DATA PROTECTION DISCLOSURE REQUEST .With a DPDR the maximum they can charge you is £10 if you was asking just for your statements they can charge you £?'s per statement.It's important to ask for any manual intervention notes as well.

Just realised you said you was asking for past 5 years statement , you can claim back for 6 years under present statue.If the amount is over £5000 then it will not be heard in the small claims court and then costs start becoming an issue.Keep your claim under the £5000.Wish I could stop editing EVERY post I make :mad:0 -

probably being stupid. Im at the starting point with the process and have been reading the FAQ's on consumer action group.
So when contacting LLoyds do i just inform then that i wish to make a DPDR detailing all my charges.

Last year, September, my wife and I started a joint account with NatWest. I transferred all my direct debits and salary to my new account and I left my old account open.
It seems that a direct debit was taken just before it was transferred to the new account. Abbey let the payment go through but placed a charge of £20 due to unauthorised overdraft. Since then they have placed a £20 charge every month. They did not ring me or write to me in that time so I assumed that everything was ok.
I received statements from them but didn't bother opening them because I knew no transactions were occurring on this account.
We decided to transfer money each month from February this year into the Abbey Account, and that is when i noticed all the charges.
I haven't yet spoken to them but do you think I stand a chance of getting the charges back - £80-100 I think in total?

I wrote to Abbey about 3 weeks ago as I had £150 of charges slapped on me for paying DD's when I was over my limit - and Iwasn't! I wrote asking for details of what they were for and used the refund me/punative charges line. Had a letter back approx 10 days ago saying they would need to investigate and would reply within 4 weeks.
Applied online for some 2001-2003 statements when I was very ill and was charged loads of charges every month because I was paying for some treatment privately and it really messed up my finances for a good year or two. Got a letter saying it had been referred to the archives section, no mention of charges, but I will be onto them if they do try to charge me anything silly!
Putting these charges on my account put me over my o/d limit and they returned a DD twice. This wouldn't have happened if the charges hadn't have been applied/they had replied faster, so I'm keeping an eye on the account to see if they charge me!
About 3 years ago, incurred probably about £100 in charges on my Capital One credit card, so i'm thinking of writing this weekend to get a list of them and ask for them back!
All a bit up in the air, but I might get somewhere!"Stay Wonky":D
