Hiya there.
This is my first post so please bear with me.
I joined a gym last year and paid the membership by direct debit through a financial services company via a credit agreement. The gym wrote to me to advise my membership was up for renewal a few weeks ago. As I didn't want to renew I cancelled the direct debit for the finance company. What I didn't realise until now was that the payments only began to be collected two months into my membership resulting in me having two months to pay (Total £56).
I have received a letter advising that one payment is overdue and they have applied a £20 charge. When I telephoned to say I thought that was excessive they advised that another charge for the return of the direct debit had been applied bringing total charges of £45 on a £56 debt. I queried this as being excessive and suggested I pay the two months now (one early, one late) and the account be closed. They rebuked this by saying if I didn't pay the charges they would apply more charges and then send a bailiff round! Is this correct? Can they keep applying charges? Am I correct in thinking that although the charges are stated in the credit agreement I signed they should not be charged if excessive?
Please accept my apologies for the length of the post but I am a little cheesed off!

Can anyone tell me what steps I should take next. I sent off my letter giving them 14 days to reply or I would be taking court action. They replied within the 14 days with a standard "sorry you're not happy we are looking into it" letter and have said they'll reply within 4 weeks. What do I do now? Do I wait to hear from them again or start court action.0

You need to wait to see if they respond within the four weeks that they suggest it may take, if they don't respond then go ahead with the next step.0

Hi there
I am currently near the end of my claim against HSBC bank but today HSBC's
solicitors wrote to me to offer £x which is approx £900 less than the
amount I claimed for. The solicitors have said that 'there is no question of
our client refunding the charges applied to your High Interest Savings
Account' which amounts to approx £900 and is listed under EARLY WITHDRAWAL CHARGES on my account statements. Should I accept the £x and drop the money claim case or am I entitled to get back the EARLY WITHDRAWAL FEES amounting to approx £900 onapplied to my H.I.S.A/C?
I know you are very busy but I would greatly appreciate it if you could
advise me as to whether EARLY WITHDRAWAL CHARGES from High Interest Savings A/C's are in fact refundable and unlwaful or not.
Kind regards

my husband received his past statements but he only asked for 5 years as he did'nt read up on it properly, so im in the process of asking for the extra year of statements.
we are also about to open another bank account.
we are fighting lloyds tsb.
am i right in thinking we can claim everything except fees ?0 -
Just to keep your spirits up, don't give up! you really will get your money back. You will receive offer of partial payment or the bank will refuse to refund the claim altogether, once you have received either one of these responses which you should within approx 3weeks; depending on the response, either refuse partial payment and go to https://www.moneyclaim.gov.uk and start your claim and if they simply refuse to refund any more also start claim with money claim. It can take 2months in total to be concluded but its worth it. Good luck0

stick to your timetable 14 days is ample if after 14 days they havent replied (which they wont) start the court action0 -
Just received a letter from HSBC offering me £1050.00 in final settlement, great, but I received another letter at the same time stating I'd gone overdrawn and was being charged £50, Arghh. Generally speaking very happy!!!0

You can claim everything except legitimate fees for services such as when you pay extra to clear a cheque quickly. If the charges are related to you having insufficient funds, they are a penalty and can be reclaimed. Do not be put off by the bank's argument that they are part of the terms and conditions that you agreed to. The penalties charged are unlawful and therefore can be reclaimed.0
