just to update
Lloyds TSB have submitted a defence, await court date.
Halifax have submitted defence and made offer but have defended charges on the wrong account.
Citibank have responded saying they will not accept as I entered into contract I will now escalate to Moneyclaim but may wait until have result of above.
Any observations?It pays to challenge0 -
Good evening everyone
This is my first post here, so forgive me if its in the wrong place. I've got two questions:
I've decided to make a claim against the Halifax for unfair bank charges for the last two years.
I've received statements and flagged up all the charges and they total £819. I am preparing the first letter that asks for the money back (taken from CAG website). In that letter, it says that I enclose a schedule of charges. Is this just something that I type up, a table for example? Or is it one of their standard documents which calculates interest at 8%? I'm not sure that I should be requesting interest now, or indeed at all.
I do apologise if I've missed something here, but I have been looking on this site and the CAG and can't find clarification.
Secondly, I used to bank with HSBC and my husband with Abbey. Both of these accounts are now closed. We paid lots of charges to each of these organisations as well. Are we able to claim for closed accounts?
Thank you very much for any advice you can offer,
Clare0 -

I contacted them today as they sent 6yrs statements through but they didnt include any kind of reference to exactly what each of the charges were for.
The chap I spoke to said 'we don't archive the charge letters for more than a year...' I asked him how they'll defend their charges when I take them to court... he said 'erm, it doesnt normally get to court..' I said 'thats because you settle?' ... he paused then said 'yes, thats what Ive heard'halifax
Ha ha great story. Get the transcript of thats conversation off them, could come in usefulLittlewoods catalogue - won back charges of £300 by default.

Hi Wilf,
Regardless of the bank's policy, your daughter is entitled to a refund on all of her charges for the past 6 years (5 in Scotland). If you go to consumer corner you will get immediate help. There is someone online there almost 24/7. The letters that she will need to get the ball rolling are all there. All she will need to do is to fill in her details.0 -

Probably still worth while getting the bank charges over the past 5/6 years from her bank to check and claim for them all at the same time
Read Martin's article and check out CAG forums and Penalty Charges, the links are in Martin's article.0 -

From Martin's article you should be looking for the spreadsheet on CAG.
Enter the charges into the spreadsheet, also provided in the Library section of the ConsumerActionGroup forum. This will calculate the interest at 8% APR as allowed by the County Courts Act (1984).

Hi just to clear this up you dont claim the 8% yet thats for the court stage all you need now is a simple list of all the charges you are claiming0 -
So use that spreadsheet but just for now leave off the interest bit! Good luck!Littlewoods catalogue - won back charges of £300 by default.
