    every claim could go to court, however it just standard. someone needs to look at your defence though
  • Im currently disputing charges with barclays, i used money claim online to do this as barclays would not pay my request. Barclays have filed a defence, and it will now have to go to the claims court. What should i do from here?
    If they go to court with a legal team and i dont have one how will i stand?

    What is my next action from here?
  • My husband and I are currently disputing charges with Barclays. We have sent both the first stage and second stage letter and have today (which happens to be deadline day!) received an offer of £700 as a 'good will gesture'. This is more than £1000 LESS than what we are asking for! We have every intention of proceeding to file a case in small claims court, but we're not sure whether we are supposed to write to Barclays and accept this offer as a part settlement / write to Barclays refusing the offer and advise them we are going to file a claim in small claims court or just ignore their letter all together! HELP!
    Also, since we originally wrote to Barclays in September asking for the charges to be refunded they have taken even more charges from our account. Should we include these new charges in our court claim or not?

    Has anyone else go past this stage with Barclays? What happened next?

  • Hi Jules, Craig, Gimmemymoneyback, Kellsbells and anyone else who is waiting for an answer,

    I am afraid that I can't help you myself other than to say that all banks say they will defend and you don't need to panic so long as you are properly prepared. But if you go to Consumer Corner they will advise you. They are far more knowledgeable than I am and I would hate to mislead you.
  • Hi and thanks to moneyexpert, just recently i have made a claim for unfair bank charges for the last 5 years at Barclays for £3500 + the £120 court fees, now they have offered a defence and i got the allocation notice which i filled in and sent back to the court, together with another £100, well now i have a letter saying that the court wants a
    1/ provide details of the account in repect of which it is alleged charges have been made.
    2/ set out the legal basis for his claim that the charges are unfair and unjust.
    3/set out a full breakdown of the way in which the sum claimed has been calculated including the date on which each charge was applied to his account and the sum on each occasion.
    sorry but im a bit of a layman and dont seem to understand what i have to do next,
    can some one please help me out here

    2) contrary to unfair terms ect.
    3) list all charges, dates ect.
  • I've printed off all my statements for the past 6 years and it totals just a touch short of £400. Not a massive amount, but am determined now to get it back off HSBC! I've tried my best to view the letter that Martin recommends to send to the bank, but am having great difficulty doing so. Does anyone have an easier link to the letter itself?:money:
  • Is it likely that barclays will turn up at court, and if not what would happen.
    Also where can i get a more expanded and useable answer to Spriggsy's question two as i have i feeling i'll be recieving the same questions.
