    I am new and posting my first thread - Need advice --Sorry!!!

    I am trying to make a claim against the abbey National - Haven't received the statements back yet, but am sure the amount is for way more than the £5K allowed in the small claims process - can i sue for all the money without a massive risk ? Has anyone done this before? on the success stories i can't see any for Abbey just some postings from "semione?????" I apologise if the answer to this is blatantly obvious but once again i am a novice!

    Also, we have two accounts with the Abbey
    One is my Partners and the other is a joint account - Do we have to pursue both the accounts as one claim or two seperate claims?

    Also My Husband is not at all confident about speaking with the bank at all on this matter and would like me to deal with it completely for him - Is this possible? Can he Authorise me to do this in any way shape or form?

    Spologies again i feel as though i am taking advantage and wanting to be spoon fed - but i really dont know how else to go about this.

    I would greatly appreciate any advice that anyone would like to give

    Just to update, I filed my claim a few weeks ago and have had this reponse on the online claim:-

    You are unable to take any further action online on this claim.

    The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

    Ive since then had a form arrive confirming that they are defending the claim and the date it was registered etc
    What happens now and what are the time scales?

    I have taken the first step and written the first letter to my bank, royal bank of scotland. Still a bit nervous.

    I simply wanted to check that everything is the same in Scotland? Am I ok to follow the steps?

    I have not seen anyone say they have claimed against a Scottish bank in the forum.


    Can anyone set my mind at ease?

    I have a letter on the computer to reclaim charges from Alliance -Leicester.
    Not a great deal of money.I don't know who to address the letter to or the address to send it to - there are two different addresses on communication from them.Also,has anyone had success with claiming money back from them?My experience of them so far has not been promising!

  • Hi i was wondering if anybody could help me. i started the process of reclaiming my banh charges with Natwest £2500 over the last 6 yrs, i got as far as the third letter saying that if i did not recieve a reply i would take them to court with no further notice. I received a letter back form them on Saturday - with in time scales. This letter said that they had looked at my account and believe all the charges to be fair and as far as they are concerned these unfair charges only apply to credit crads and they will not be refunding!

    What should i do - carry on with the last stage and request a court date - or give up at this point and admit defeat?

    Hi Alan, glad to hear you signed up after the Jeremy Vine show :)

    If you sign up for the CAG forums you'll find a board there for each different bank and also one for dealing with the court system in Scotland.

    hiya, this is just natwest standard reply i have won them 6 times, keep at it, they will defend the court claim but they will also pay up ;) they are hoping you will back off

    Does the reclaiming of charges also apply to Student Loans, which are also excessive.
