  • I have written the first of the letters to my bank to reclaim bank charges; asking for the last 6 years statements/info on my account as I have not kept all my statements from the last 6 years.

I have just received a letter back from my bank stating that under Sections 7 and 8 of the data protection act 1998 they can only provide such info 'if it does not require significant effort on the bank's part to locate and produce' and as I am asking for 6 years' data this would cause them significant effort and they are asking for £6 per page for the statements prior to 2004.

This as with all the other fees and charges seems ridiculous. Is it worth paying the £6 per page in the hope I might get back several hundreds pounds back?? I have already paid the £10 fee as required under the Data Protection Act. ????????

I think they're trying to fob you off! HSBC have already given me 6 years of statements for my personal account, and returned my £10 cheque! Personally, I would write to them again, but be more 'threatening' with a definite intention of seeking legal advice. If they don't back down then, start court proceedings (see the 7 point guide on this website - very straightforward).

However, I have been trying to find the account number of one of my buisness accounts as my statements are in storage, from Nat West. I spoke to 4 different people including the Business Centre, and my local branch. They claimed they had no record of the account as it was closed 18 months ago, and would not point me in the right direction at all. However, they gave me the account number of an older business account over the phone??? I'm not sure if this is an honest system request that cannot be done, or they are getting clever at giving as little help as possible to customers?

Again, I would strongly advise that you get tougher with them - think about the money!!

How can you stop the banks/cc companies making further charges post claim?

  • I guess the process keeps on going until the charges / laws are changed to be mutually beneficial?! Just because we can claim once, I guess it doesn't mean that we can't keep on claiming?? Advice appreciated...!
  • How long did the process take?
  • Hi all
I followed the advice about pursuing the Abbey for charges of over £2500. Today I checked my account and they have refunded half of the charges into the account. I have received nothing in writing and sent them the the third 'letter before action' at the beginning of August. I'm not sure what to do next? Any advice?

Can anyone help? I'm claiming back charges on 7 bank accounts and credit cards.

3 of the credit cards have been closed in the last 6 months.
2 of the bank accounts were my business accounts and were closed in March 2005.

Can I still pursue the charges claim even though the accounts are closed?
I presume the bank will still have records of my accouns?

    Cheers

hi dan, yes you can claim on closed accounts and yes you can claim for business accounts, they have to keep your records for ten years. go to www.!!!!!!.uk all the template letters are there for your circumstances
