    I've just looked at my request for statments from Abbey (22/6) their reply on 10/7 said that they were sending me 12 months of statments, which they did, but the rest were held on microfiche. As I had already paid the 10 pound(I have lost the pound sign on my keyboard) they would forward it. I've just rung up (12/08) and been told that microfiche is not subject to the banking code and that they may take some time to reply. Is this correct?
    Abbey have sent them an urgent fax as they apparently cannot be reached by phone!!!Will update when there is anymore movement.

    you need to send them a letter chasing up the list of charges, allthough it has nothing to do with the banking code, its the data protection act of which Abbey are the worst at complying. go to www.!!!!!!.uk there is a reply already for this situation.

    I am currently referring to Moneyclaim can anyone offer hope that I am not throwing good money after bad.

    only one person has ever gone to court, and he lost on a technicality, but then appealed and the bank settled out of court. and that was the first case brought to the courts since then the banks have not set foot in a courtroom.
    so no one has lost and if you follow the procedure properly neither will you. ;) if you read my thread on closed accounts you will see they felt the same way. but they have just recieved a cheque for over £1700

    I recently wrote my building society, Nationwide, using the letter template in the library. I have recieved the following reply:
    Thank you for your letter of 29 August 2006, about charges incurred on your FlexAccount.

    We appreciate the time you’ve taken to get in touch with us about this issue, and are grateful for the opportunity to explain the rationale behind our charging policy. We are aware there has been a lot of speculation about fees and charges in the media and that the Office of Fair Trading has issued a directive regarding credit cards.

    As you know if we allow items to be paid and it means you exceed your agreed overdraft or we have to return and item unpaid on your account then we will make a charge in accordance with the terms and conditions. Details of our tariffs are contained within our ‘FlexAccount Interest Rates and Charges’ leaflet, freely available in branches and provided when opening an account and agreed to by yourself when you sign in acceptance of these terms when signing the application form.

    Nationwide believes it is open and transparent about charges and members are pre-notified prior to charges being debited via their monthly statements. If, at any time, we make changes to the tariff, account holders are always informed. We hope that you will feel that you can abide by the terms and conditions of the account but if you cannot, then regrettably it may be appropriate for you to consider alternative banking arrangements.

    I hope that this has helped to clarify our position and you will appreciate why I am unable to refund any charges on your account. If you have further queries don’t hesitate to call me. My contact number is XXXXX XXXXXX.


    Am I right in thinking that I should simply proceed and send the 'Letter before action' to them? I am uncertain whether this reply is simply a standard letter or whether it constitutes a considered response. Advice would be appreciated.

    In particular, if there are any other Nationwide customers out there, I'm interested in hearing from you - did you recieve the same reply? If so, how did you progress? Of those who have successfully reclaimed charges from Nationwide, was this letter sent to you earlier in the process?

    I notice that Nationwide defend the charges as laid down in their published tariffs, rather than making any attempt to defend them on the basis of cost, so I'm assuming this is just a standard reply, but i would appreciate guidance.

    hi, yes this is just a standard reply, you need to send the lba now, allthough you will get the same response. go to www.!!!!!!.uk for all the advice an letters you need

    Just wanted to say a big thanks, I received a cheque from Halifax this morning for the full amount they owed me, I can't believe how easy this has all been. I think I'm going to pick on barclays and captial one now,

  • Can anyone help? I'm claiming back charges on 7 bank accounts and credit cards.

    3 of the credit cards have been closed in the last 6 months.
    2 of the bank accounts were my business accounts and were closed in March 2005.

    Can I still pursue the charges claim even though the accounts are closed?
    I presume the bank will still have records of my accouns?
