    Hi,

Believe it or not it was a customer service advisor at my bank who first (off the record) pointed out that I could claim back charges. Due to a lot of money problems I had been charged £1200 over only 4 months and as such had written to the bank complaining. That was 3 weeks ago and I have yet to hear back but on investigating further am now wondering about going back the full 6 years (which would probably double this at least). Would it do me any harm to pursue this current amount first then try for the older stuff?

Also I notice theres not been many replies to the Scottish queries and just wondered if anyone had pursued RBS and what luck they'd had - or not.

    Thanks very much

hi certainly dont wait for them to investigate thats what they are hoping people will do, you give the deadlines now not them. there is no point whatsoever in persuing one and then the other you are just better off sending of the 14 day letter at www.!!!!!!.uk for the full amount.
there is also a letter for warning them about taking more time than allowed in investigating the matter.
  • Hi,

Now progressing to the stage of completing the spreadsheet to send to the bank, just wanted to be clear with it. The example spreadsheet shows charges inrespect of either unpaid CHQ charge, unpaid DD charge or cleared transaction. In the early days of the HSBC the charges were applied to the account about 3 weeks after going over the overdraft limit and not as soon as you went overdrawn through a direct debit which they do now, which i am assuming would be classed as an unpaid DD charge. Just dont want to make any errors and so does anyone know what that charge is classed as if it was applied 3 weeks later and when to use cleared transaction.

    Thanks for your time.

not totally sure which spreadsheet you are using but the one on www.!!!!!!.uk is very easy and straightforward to use, but yes the charge in question would be an unpaid dd charge.
  • I based mine on how the charges were classified on the statements themselves, ie what the bank called them. Do you not have this information?

yes they have acknowledged thats all, very normal and nothing to worry about the next step is for them to put in their defence. (if they bother to)
you need to watch out for them defaulting now. 28 days from the deemed served date. only one person lost (on a technicality) and he won out of court once he appealed. you will win if you follow the advice. go to www.!!!!!!.uk
