Hi, thanks guys for your advice much appreciated. Will re-do letters I think rather than appearing to change goalposts. I'm in no rush so if I have to consider going to court would rather do it properly and for more money as weather I take them for £1700 or £2100 the outlay is still gonna cost me the same!!!. I just wanted to clarify if anyone knows are the £10 card mis-use charges considered a penalty as after talking to a guy at HSBC they reckon they are not (although they would say that wouldn't they!!). Will let you know how I get on.Remember ....its not a bargain unless you need it0 -
it would depend on what the mis-use was? if it was for spending more than your limit, and they honoured it. then no it is legitimate0

Anyone got any idea what to expect now, and how long things might take? I'm claiming about £2250 including APR from Lloyds TSB. I gave them plenty of chances to pay up without interest, so I'm quite pleased now I'm in line for an extra few quid. I'll post as soon as I hear anything, and hopefully that will encourage a few more people to take the plunge. Fingers crossed!0

there is a few things that could happen some times (but very rare now) they pay up straight away. but more often than not they will acknowledge and put in a defence. but watch out for them defaulting on the timescale at court as if they do you win.

Sent Abbey my initial letter (after trawling through statements), with my schedule of charges, and had a letter back stating they would look into it.
Last week, a ton of 'refunded charges' were deposited into our account with no explanation. Called them today and they explained that they were 'willing to repay' £780 minus £155 of oustanding charges(!), which accounted for the £625 in our account.
The lady I spoke to was very pleasant, but basically told me that the OFT ruling I referred to in my letter 'covered credit card charges not bank account charges' and overdraft charges/direct debit charges aren't covered. She told me that Abbey feel their charges are fair (£20 for unauthorised overdraft, £30 for cleared Visa payment, £35 for unpaid DD!!!) and that they make it all clear in their smallprint. She said I could take it further if I wished, but they will stand their ground. According to my up-to-date (as of today) spreadsheet, they have taken £3011.50 in charges in the last six years and they feel that £625 is fine.
Questions: has anyone else dealt with Abbey and where do I go from here? I am still entitled to the rest aren't I?

Whoops! I sent my initial letter straight to Nat West at 135 Bishopsgate! I thought if I sent it to the branch, it would just get sent on to Bishopsgate anyway - so I thought I would speed things up by going straight there. Should I start again with the branch or do you think it will be OK? I sent it recorded delivery on Monday.0 -

your next stage is court. we have members dealing with abbey and they are know different to any other bank they are not above the law. go to www.!!!!!!.uk all the help and letters you need are there.0 -

Interesting to see where you can get your money back on bank charges..
But I am sure I have seen in small print that the bank are allowed to charge if you go over drawn esp when you have signed agreementWhile I breathe.... I hope0
