MortgageMama - i can't!!! I'm just lodging 2 claims, & expect to be in the same position, so am eagerly awaiting a reply. If you look back through the thread & elsewhere you'll find reassurances. I'm going to do so later, but have a go...it's all there!

you certainly dont give up, they are counter suing just for that purpose. to win a counterclaim they would have to enter the courtroom which they will not do..
carry on with your claim. its just more scare tactics. go to https://www.!!!!!!.uk/forum an they will help you all the way through it, all the letters you need are there and if you need one especially writing for your circumstance they will do it.

Have a look at the forums at https://www.consumeractiongroup.co.uk. There you will see no-one has ever actually had to go to court. I'm taking on Barclays at the moment and they will only settle in full a week before the case is due to be heard. Your bank may well be adopting the same tactic. This appears to be their way of intimidating and putting off people from pursuing all their bank charges.
FWIW I have taken my wife's ex-employers to the small claims court, had a hearing and it was all pretty painless and not confrontational as you were presenting your case to the judge only.

you can reclaim interest on cahrges but it is a nightmare to work out, however if your overdraft is made up entirely of charges. ie. the claim is more then the overdraft then yes you can reclaim the interest quite easily as it is all the interest from the point the charges amounted to the size of the overdraft go to www.!!!!!!.uk all the help you need is there0 -
Hi just a bit of advice required. I sucessfully claimed back over £1000 worth of charges from HSBC on a open account a month ago. I have since claimed 6 years of charges from HSBC using letters 1 and 2 and they have basically said no go away!! I can either go to court with it or I have another plan! On my claim I only included charges over £12 but am lead to believe that any charge such as a £10 charge for card mis-use is still considered a penalty charge if this is the case do I proceed with my current claim or leave it a couple of weeks and claim again including over £300 of extra penalty charges I have found? Although I would probably settle now if the option was there but if I have to take it to court would rather do it for a worthwile amount and these extra charges would take the claim to £2100.
Any advice anyone??Remember ....its not a bargain unless you need it0
