dunniebhoy wrote:Hello money savers,
I am currently in the process of reclaiming unfair charges from Lloyds TSB, it has got to the stage of them entering a defence and I have today received a court allocation questionaire.
Has anybody had to fill one of these forms in, if so could you please give me some advice on certain parts of it:
Section E - Experts
Section G - Other information
Any help would be greatly appreciated
Many thanks
hi, there is a full template at www.!!!!!!.uk to guide you. experts is no and other information is to ask for disclosure which wont actually happen but it covers you. is there anything in your defence asking for anything. is it standard?0 -

Your link was very helpful in filling out the questionaire. the defence entered by lloyds tsb is a bit long winded, but seems fairly standard to me (but then again what do I know) It doesn't ask for anything either.
Thanks again dunniebhoy0 -

I had an annual bank debit that comes out of my account each august, but had forgotten about it, duh. Anyway, it was the first time I had ever been overdrawn, and was charged £38 for going overdrawn. So I used the information on this site and emailed Natwest about it, stating that I thought that the fee amounted more to a penalty charge than a processing fee.
Today I got this email back,
Thank you for your e-mail.
It is your responsibility to ensure there are sufficient cleared funds
in
your account by 3.30 p.m. on the working day before any items are
presented
for payment.
The fee represents the sum of administrative and processing costs that
are
incurred by the Bank in returning an item unpaid, however it is
impossible
to give a specific breakdown against any one transaction.
We believe that our charges are fair, reasonable and transparent. We
consider that the amounts debited to your account have been applied
strictly
in accordance with your agreement with us and our published tariff
which, we
are satisfied, complies with all applicable laws and regulations. We
are
also committed to ensuring the transparency of the information that we
give
to our customers about the operation of our products.
Much of the recent media coverage on bank charges has been prompted by
the
Office of Fair Trading investigation earlier this year but that was
limited
to administration charges on credit card accounts and did not extend to
include bank charges.
We have considered the Office of Fair Trading's statement of 5 April
2006
and do not accept its findings in relation to the setting of credit
card
fees. We are concerned that the Office of Fair Trading has publicly
called
into question the setting of charges applied to other products,
including
current accounts. The Office of Fair Trading has restricted its
investigation to credit cards and made no attempt to consult with the
RBS
Group or the industry in relation to other entirely different products.
On this occasion only I have arranged to refund £38 to you and this
will be
processed within the next five working days. Any further charges
debited
correctly in future will be payable by you and any future requests for
a
refund will be declined.
I hope that I have clarified and resolved matters for you.
RESULT!!!!!!!!!!
Fees refunded!!!!!!
Thanks for all the advice on these pages!!!

have you sent a data protection act letter. if so then they cannot charge you for a list of charges, allthough their usual excuse for statements is they are on microfiche. go to www.!!!!!!.uk
everythin you need is there whatever the circumstance0 -
It looks like the Banks have had enough?

Yeah, more Daily Mail propaganda.
Let's see it I say (I very much doubt the banks have got the cojones to actually do it). I'd rather pay a few quid each month for a service than sit by and have 'free banking' while people who can least afford it get fleeced.0 -
Hello, am trying to relcaim my bank charges from Nationwide. Have sent out my second letter and today got a letter back saying they are not paying me the money back.
Am going to file a court proceding through the money claim link you gave, but I notice when it talks about who can use the service it says you have to have an address in England or Wales to recieve mail.
I live in Northern Ireland, what should I do? I have come so far over a long time I'm not giving in.
Any help much appreciated!
Thanks,
Jonny0
