  • Hi, I'm new so apologies for any mistakes.
I got myself in to debt after my divorce and am slowly sorting myself out wwith the help of the consumer credit counselling service.
I was with the bank of Scotland ( Halifax) for years ( now with another bank)and am paying them back a token minimal payment each month on money I owe them ( approx £8,000) which they agreed to.
I am quite sure that after all the ears I was with them I was charged loads of charges due to overdrafts etc. As I still owe them money would it still be worthwhile for me to ask for a refund on these charges or do you think they would get nasty and I would be worse off? Can anyone out there advise or been in a similar situation? Thanks

hi, you should claim the charges back, the worst they could do is start saying they want more money, but they have got to accept what you can afford and that is exactly what a court would say as well, it would also be considered retalitory action, which is very much frowned upon by the oft.
so my advice is claim your charges back asap. and if they start being awkward about the repayments send them a letter warning them.
you will find everything you need at www.!!!!!!.uk
if you need that letter just post on there and i will be pleased to sort it out for you.
  • Hi guys.

I'm new here, but saw an article about bank charges a month or two ago and couldn't resist checking out some information about the process of claiming back some of it! I graduated two years ago with a healthy (ie: big) overdraft, which I'm trying to shrink now that I've got a job.
I accept fully that I will incur charges if a cheque bounces, or I go over my limit, but the extent to which they demand money is getting stupid. I thought I'd try my hand, see what happens and got a letter back after two weeks, offering me £180 without claiming liability. Very nice!
However I've not accepted this yet, as I'm going to see what my 6 years' worth of fines accumilates to first. This is a wonderful site, as I'm sure there are hundresds of people who are too scared to go it alone. Brilliant support this, guys. :)
  • Hi all

New member as well, joined today, site is excellent from what I have seen.

I have a similar sort of problem to the original post, I got into debt with RBS & HSBC and my wife with the Halifax, we came to agreements with them all directly or via their debt collectors and have been paying off a nominal monthly amount. Currently there is approx £6K outstanding of which I would guess that the charges etc would be in the region of £2 - 3K as we ignored/avoided them all for a long time. I would obviously be intersested in claiming this back, would this be possible because the debt's and charges are older than the 6 year threshold.

Any idea's would be greatly appreciated.
  • unfortunately if the entire debt is over 6 years old you cannot claim, allthough if some of the charges are within the time period, you can claim these. there are other ways to deal with it as well and maybe (only maybe wipe off the whole debt) go to www.!!!!!!.uk and post as much etail as you can and i will point you in the right direction with letters etc.

    Dear Sir/Madam

    ACCOUNT

Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable.

Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you.
If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

I enclose a cheque for the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee.

If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable.
I would be happy to collect the Data from my local branch.

    Yours faithfully,

this is what i sent so when will the accounts be in dispute?
  • Just had enormous bundle of bank charges from Lloyds and have list of all charges/dates, etc, totalling over £1000.

Is there anyone out there that would be willing to take a look over what I've filled in on the form that has already done it. The 8% has confused me. Do I just leave this in or what????

Lloyds only got my statements to me just 2 days after their deadline and I think I might be fighting a losing battle.

    Has anyone had Lloyds success.

  • I discovered today that an unauthorised withdrawal was taken from my account for an insurance policy. I did not ask for the policy to be renewed, nor did I authorise any payments to be taken from my account. Who do I now claim from? Do I claim from the insurance company for taking the money without asking or do I claim from the bank for releasing it in the first place? As a result I was charged an unauthorised overdraft fee of £30

Needless to say, I'm not a happy bunny  and I want my money back :(

Any advice would be appreciated as I have never been in this situation before.

    Thanks :)
