you need to put a sum or at least an estimated sum based on the amount you know about.

your best bet however is to start from the beginning by requesting your statements under the dpa and telling them to not register any defaults under section 10 of the dpa.

hi, it seems that they still have not taken payment, so the best thing you can do now that it is recorded is call them every now and then (pester them) if they think your not bothered they wont be. the 40 days do not start until they cash the cheque, the ico will probably do nothing just yet. they are so busy that they want to see you have done everything possible first. which you will have done once pestering them for a while. also write them another letter explaining about the £10 charge and explain what you have said about only charging if they have the cheque. you can claim that charge back as well as the £10 for the statements.
    dont let up ;)

    Thanks for your help.

After sending it by recorded delivery the bank has amazingly acted very quickly and i have my statements. just in process of going through them. Will let you know how it goes.

  • Hi All,

Just signed up, thought i'd say hello. I too am tired of the bank taking funds at will from my account and i'm about to set on the trail of reclaiming my bank charges with the help of this site. I banked with RBS with a current and business account but through this site i have opened a new account with A&L. In 6 years of bank statements i estimate at least £6000 in charges. Although i had my business acount with RBS for 22 years i have now closed the account, can i still reclaim the charges even though i have closed the account?

    Thanks

hiya you guessed right, the service charge cannot be reclaimed, and only the interest on the charges can be claimed which can be a nightmare to work out.

Has anyone ever thought to use the Freedom of Information act 2000 to request a full breakdown of the charges incurred to banks with respect to breaches of contract?

    Is this possible?

Surely this would give absolute proof that the charges are disproportionate to their costs and everyone would be entitled to an automatic refund?

Unfortunately the Freedom of Information act 2000, is for public authorities, and public companies that are owned by the government, and not privately owned companies.
  • when exactly will the account gointo dispute?
will it be after the bank act on the DPA letter or when they receve the clam letter?
