  • Hi there everyone in just checking to see when i should enter my default claim, i made my claim on the 10th but the bank only acknowleded on the 14th does this mean i count 28 days from the 14th ?? Im hoping that they have forgotten:T but im thinking that i may get a letter on monday who knows ! cheers

    hi, if you filed the claim on the 10th it would be issued on the 11th, then deemed served on 16th, then 28 days = 14th september, all is fully explained at www.!!!!!!.uk

    yep they probably recieved it the same day as you but the rules say it isnt deemed as being served for 5 days after issue even when they ahve obviously recieved it before that totally idiotic but thats the law for you.:confused:
    cant knock the law to much at moment though. ;)
  • could anyone tell me if you can reclaim cheque charges, i have been charged about £280 recently for bounced cheques yet the money has been there. i sent them the initial request for repayment and they wrote back saying the oft's report doesn't cover these charges just credit card charges, are they fobbing me off as i think so?

    hi yes they are fobbing you off, and you certainly can reclaim these go to www.!!!!!!.uk everything you need is there

    I have taken the Royal Bank of Scotland to court re bank charges, im not sure that i have done everything right, they sent me 210.00 goodwill gesture which i refused but it was left in my account. i then sent a lsit of charges to make sure they were correct they debated 2 of the charges so i deleted them and then obviously changed the amount. The bank have put up a defence stating that they didnt know why i had sued them as i had not laid out the particulars, this letter was sent by the solicitor. I emailed them the reasons for the claim then recieved a court questionnaire which required another £100 charge. We have already paid £130 out and i am becoming concerned that i may be getting myself in too deep. I do not want to go to court and lose on a technicality therefore ruining everyone elses chances of getting their money back, i followed everything as laid out in the step by step advice until i lost my nerve, delayed then sent in the spreadsheet querying the charges, i asked them to check that the charges i had requested back were correct 2 were not so the amount I have asked for has changed from what it was in the begining. Im also unsure as to whether all the charges are illegal or just some of them, i know that the banks having a hell of a time with my account at the moment while im on maternity with much less money than i had coming in, they seem to be taking charge after charge and i cannot get straight. Help im fed up wih the bank but dont know if im able to sort it out if it does get to court.

    could you please advise.

    Hi, dont worry it seems everything is correct, and the fact that they have stated 2 of the charges are incorrect has proven they acknowledge what you are doing. go to www.!!!!!!.uk and email or pm a copy of their defence and what you have sent them and i will gladly look over everything for you and make sure you are on track.

I'm in the process of taking HSBC to the small claims court, they have decided to defend themselves rather than pay up...just my luck!!! They could be calling my bluff of course. Anyway, I really need some help/ advice. Has anyone else gone this far yet? I've not got a court date yet, I'm still in the early stages, but I need to start putting a case together. I know from the success stories that HSBC have paid out to some people, and I've contacted these people as I feel this goes in my favour, but I'd really like to hear from people who have gone all the way as it were.

    Any help much appreciated

    they are calling your bluff, they will not go to court and this is just the standard tactic used by all banks hoping you will go away. ont start panicking and there is certainly no need to start putting a case together yet.
    when you get a copy of the defence you need to see if they are asking for anything ie. more info. go to https://www.comsumercorner.co.uk all the help and advice you need is there, i will be pleased to take a look at the defence for you and make sure everything is in order
