    Hi All intresting coments by all however before i clame from my bank i wonderd if someone could let me know or point me in the right direction to the following.

    1 what section of the unfair contract terms act 1977 or the 1999 consumer credit act are the banks brakeing?
    as i am in scotland and some of it dont cover scotish law

    2 can i clam back on 2 or3 accounts in the same clam? i have 2 accounts and a closed buissnes acount all have had charges within the last six years .

    3 if it's a joint acount and i clam back charges will that afect any loans in the other persons name I.E can the bank foreclose on there terms and condiitions.

    any help would be helpfull

    Can someone please advise me on how they worked out the total amount they were owed from bank charges?

    I don't have all my statements and my online banking doesn't go back far enough. From online banking I have so far worked out that I have paid £439 in charges from 25/05/06 - 01/08/06 so I am very eager to get the full amount owed and not let them off with anything!

    I could ask for statements to be sent to me but I am pretty sure they charge for this (there is a surprise!) and I have a feeling it may not be in my interest to phone and ask for them to tell me how much I have been charged in total on bank fees.

    Can somebody please assist me with this?

    You had best read the article this discussion refers to before you get stuck in.

    You need copies of the last six years bank statements in order to prepare a schedule of charges. You can get those by applying to your bank in writing and asking for the info under the data protection act and sending a cheque for £10.

    received a response from Nationwide saying that they are aware of all the media surrounding reclaiming bank charges, however the charges are clearly printed in the terms and conditions and it is my responsibility, so they are unable to refund!

    I've made successful claims for myself and my brother and am now looking into some charges against a friend of my dad. I have a couple of more complex questions and was wondering if anyone could point me in the right direction.

    1) If they include closing the account as part of the conditions of settlement, can I just not accept and force them to drop it (a bit like with confidentiality clauses) or go to court?

    2) What's the best procedure for claims over £5k?

    Sounds familiar! post just arrived and Ive received a letter (after only taking the statement request letter in on friday afternoon). They have sent me a complaints proceedure leaflet, and also state that they are sorry Im unhappy blah blah, that they have also sent my letter to the Retail Regulatory Team ??-who are they??- and that they will contact me within the agreed time scales. They also state that they are comitted to resolving my complaint quickly and completely to my satisfaction,.....why do I smell a rat? Cheers,

    i had the same letter from Halifax but after a couple of weeks received an offer of half of my charges back - stick to my guns and refused this and within another 2 weeks i received an offer of the full years charges

    i printed off the Court Claims form and sent it to them stating that i would start proceedings within 14 days if no reply is received and this is when they made their first offer - i think they just send that letter as std to put you

    still waiting for contact from Halifax tho - see my post from yesterday

    I had just over £100 back from Nationwide a couple of months ago. It is all down to whether they think you are serious. Have a look at https://www.bankactiongroup.com web site and send them a 'Letter before Action' giving them 14 days to cough up or you will start legal proceedings. If they don't pay, then go ahead and issue a summons. All the help you will need is over on CAG.
