I have just added up my unfair charges on a halifax visa card going back 6 years. At the moment I am being charged £25 overlimit fee, £25 late payment fee (sometimes) plus card protection of around £27 per month. I assume I can't do anything about the card protection but what implications will there be if I cancel it? Thanks to anyone who knows this out there, what with this credit card and a current account I used to have with the Halifax, the total charges come to around £3000 so I'm pretty keen to get it back if I can!!

Hi there. This is my first thread and would appreciate anyone that would be able to help me out.
I have been in debt consolidation for the past 4 years, this also includes the length of time that my bank accounts have been closed due to me getting into financial difficulties, and whilst having these hard times, my bank was not prepared to listen or help me and each time i was going overdrawn i recieved the following charges just like everyone else has encounted.
My bank was Lloyds Tsb.
My question is this:
would I have any rights in pursuing my claim to refund these bank charges back to me despite my previous problems with them? or am I just wishing an impossible dream. I am currently following the correct procedures in recovering my wife's charges (my account was totally seperate to this as we wasn't with each other at this time).
any help on this matter would be gratly recieved.

any 'problems' you may have had with a bank are totally seperate to the fact that they have illegally charged you. You still have rights! They might see you as less deserving of the charges in some way as you broker the T&C's more, but a court certainly wont.0 -

Yes bank can charge you the ten pounds it states it in the T&C's of your account under personal data you should read these before any action is taken.

hi can we get a refund on more than one acount in one request for repayment?
and can anyone tell me what section of the 1977 unfair terms act. or the 1999 consumer credit act the bank is actualy in brech of?
also in the letter template to your bank asking for repayment it states that OFT reported on 5th April 2006 that the charges were unfair.
this only mentions credit cards did not once mention bank acount charges.
Have the OFT published something that is for bank acounts.
just trying to establish all the facts before the bank finds a way to wrigle out of repaying
any help would be very helpfull

I've sent my inital letter to Halifax for them to send me details of charges for the past 5 years, and their 40 days expire on the 1st of September.
Currently I'm still yet to hear ANYTHING from them, which I suppose is to be expected.
Is my next step to report them if I don't hear anything in 40 days?
Also, am I to then send a 2nd letter to them threatening court action?
I'm a little confused because I don't even know the amount I am claiming back.
I know for the 12 months of history that I have, charges do exceed £900.
Really I want to make sure I'm going about this correctly because I don't want them to wriggle out of this one!!
After the years of unhelpfulness they've given me!!!!
What's the general feeling here?

You send a letter saying they have not fulfiled their responsibilities of the data protection act and you will take the to court to enforce compliance. The template letter for this is in the libraries forum at CAG.
note that this threat of court is not to reclaim charges, simply to get your statements.
ps. you must have paid them the £10 and waited 40 days for this to be a valid course of action.0
