your originally intended court action is to reclaim charges...however you dont yet know what the charges are!
If their 40 day deadline is up, you need to specifically tell them they have failed to comply with the data protection act by not supplying the information requested, that you will lodge a complaint with the information commissioner (only say this if u are prepared to follow through), and that a court order will be pursued to enforce compliance.0 -
i had already followed all of the steps to get to the stage you mention - i sent them a copy of the court claim form and gave them a deadline. when this deadline was up i wrote them advising that i was about to start court action and the following day i received a letter agreeing to pay the £375 to my card account. This was when i replied with the form they enclosed stating that i accepted the refund but on condition that they send a cheque or pay into my bank account as i didnt want my refund swallowed up on a card i no longer am able to use and i see this as basically them keeping the money. It is this letter that i have had no reply or action from in the last 2 weeks. This is why i sent the letter on my monday stating that if i dont hear from them by monday then i will carry out my original plan of action.
this is why i am wondering whether anyone has had the same problem with either Halifax or any one else.0 -

thanks - fingers crossed that they get back to me soon - i'll keep posting my experiences as this is the first in a long line of banks/cards i intend to tackle for ruining my credit rating etc0 -
hello to all, im new to this site and very excited about the prospects of claiming back unfair bank charges. could any one out there let me know if there is a draft letter requesting a list of charges from my "BANK", if so where do i go to retrieve this document. thank you for your help and good luck to all reclaiming your charges.0

Hello again,
I got a reply from NatWest this morning. Stating they think their charges are transparent and fair etc. etc. and they have offered £38 compensation as a gesture of 'good will' however, this isn't the full amount I am trying to reclaim.
I've looked again at the CAG website but can't find a letter template for the banks if they have replied within the time period...can anyone point me into the direction of one or give me advice on what I should do next..

4th August 06- OH took DPA letter to local branch, got hassle but nevertheless, got copy of letter (dated and stamped), also a full receipt.
8th August 06- letter received stating the letter had been passed to the Retail Regulatory Risk Team, they were very sorry and they would try to resolve this etc, accompanied by a local branch direct number on a pretty card. (Had tried to get a local no before on numerous occasions but was fobbed off and told to call the national number).
Have been searching everywhere for a spreadsheet that calculates interest (cannot gain access to the main site everyones using despite using various email adds)
Is it 40 WORKING days when I can proceed to the next stage, or 40 days form 4th Aug.
Does anyone know who the above Retail Regulatory Risk Team are!!
I appreciate anyones help/input/advice etc....many thanks x0 -
i am going to go through this procedure and try and claim for unfair bank charges.
ive also notice (dont know how i overlooked it) that payment protection is activated on my account, to the tune of £10 a month. it is now stopped but when i asked if they had the proof on the application form, the first guy said it wasnt on the stored T+C that i signed (they have scanned it in) but they said it was an online application and i had aggreed there. how can i chase this up?
