If you want the interest as well you'd better calculate exactly how much and why.
thanks

yes calculate exactly what they owe you.
But only interest that would not otherwise have been charged if it wasnt for the initial charge.
The 8% interest is ONLY to be used when you get to filing a court claim/.0 -
Gotcha! I've worked out the 8% up to today anyway - my first ever foray into the world of Excel except for race results...
I will now prepare my LBA, & get it off today or tomorrow at the latest. The LBA letter repeats the prelim letter quite a bit, & they HAVE replied, & haven't entered any default that i know of - so not a lot extra to say really, except to reset the clock.
The way i calculated the interest on the unfair charges was to calculate that the charges represented 1/7 of the total O/D (as they did almost exactly), so i claimed 1/7th of the total interest charged. Trust that is accurate enough???Or should i get it spot on at this stage?
I trust your wisdom as you've been the voice of reason so far.
Off to buy more stamps!

My bank is at the stage of saying that the charges are for an extra service and therefore not a penalty, and thus legally enforceable. Anybody got a reply to this0

I have had with Barclay's a number of diiferent accounts over the past few years and would love to know how many times i've been charged on all of them since i open my first account back in september 1989.
Couple of questions
1. I am correct in thinking i can only claim back until August 2000 (6 years ago from this date)?
2. Do i have to give them a cheque for £10 for each different account, as they where all linked (current, bills, saving account)?
If anyone can get back to me quickly it would be greatly appreciated as i'm going to the bank today and would love to drop the off the letter requesting all charges in person.
Great site by the way, telling all my friends about it!!0 -

I'm claiming two things from my bank (a) the normal penalty charges, that is the usual £30 for telling me I'm overdrawn and (b) ALL of the interest they have charged. I'm saying the interest is unlawful for TWO reasons, firstly they are using about 60% of the interest charges to cover their losses from debtors and global losses. In other words they are attempting to make me pay for the debts of others, which is contrary to contract law, secondly they did not tell me in clear unambiguous language the reasons for these charges. Therefore any contract term is unlawful.
I've also stated that if I am forced to pay for the debts of others I want the banks to supply me with the goods and services that I am forced to pay for.
I've already commenced court proceedings. My bank has stated its intention to make a defence but I've not heard anything yet. Their 28 time limit is up on the 28th August.
Anyone got any advice.0
