thanks to everyone who has replied so far but alot seems to be contradicting what i have read elsewhere and on the CAG. People are being told to close their accounts before making such claims as the bank will close it - how do those people then get refunds to their latest accounts. I have been told that however the charges are bought about the charge is unlawful and is legally my money. The reason i can no longer use said card is that it has been cancelled and i am having my debts dealt with by Payplan - the fact is that such charges contributed to the fact that i am in this situation and now i learn that there is a chance to get some kind of recompense. I dont see why this amount should then go back onto that card so they in turn "win".
As it is legally my money, as i have been advised, surely means that money should be paid to me personally. This is what i have read on other forums from other people.
I intend to do the same with my old Halifax account although i no longer have access to this as the treatment i received from them even though i was a customer for over 11 yrs was disgusting - i complained to the ombudsman but they just took their side. That is another story though - my point is if i am not to see a penny of what i see them owing me then i might as well not bother and give up now.
As for me suing the bank - and for what - i am following the advice i have recieved elsewhere - the money is legally mine and i want it paid to me. they are not agreeing to that and this is why i continue with the legal action. This again is what i have read elsewhere.
If i am wrong about all this can someone let me know and i'll throw in the towel as the process is long and stressful and i'm not going to put myself through it if i have completely misread all of the advice and i am in the wrong.

I'd say that effectively the bank effectively has a debit and credit on its books that are in the same right, if the situation is the same as X's, an amount owed by X to the bank/card co, and an amount die to X by the bank/card co. Therefore. I would say that the bank has its right of set off availanle to it and any payment to X direct would be an act of grace and favour0

If you owe the bank £2000 and they have stolen £1500 off you, you still owe them £500, there is no getting away from that. If they refund the money to your account it goes from -£2000 to -£500.0

..although in your earlier post you did say that they offerd you a cheque...
'When they offered me the £187.50 refund they enclosed a form that stated i return it and the money will be added to my account or they would send a cheque.'...

let me know know more aboput this (allegedly) i been trying to find solid prof of them being unlawful and i cant find any hard FACTS and as i have said before courts act on FACT!

The Liberal Democrat MP for the West Cornwall and Isles of Scilly Constituency of St Ives, Andrew George, heralded news of the outcome of a recent County Court case on behalf of one of his constituents, Laura Saunders (of Goldsithney) which resulted in her victory against Yorkshire Bank plc in respect of bank charges amounting to £922 during 2004. Following what could be a very significant test case, Mr George believes that many banks should review their treatment of low-income bank account holders and has referred the case to the Secretary of State for the Department of Trade and Industry - Rt. Hon Patricia Hewitt MP - who has been encouraging pensioners and claimants to open up bank accounts to receive their benefit payments, rather than to receive them over the Post Office counter.

Exactly my point - when they made the offer of half a refund as goodwill gesture i refused and sent the next letter as recommended on here and on CAG - because of that refusal it now goes on the card instead.
I'm confused by the whole thing - i must've misread alot of this stuff along the way somewhere.0 -

Hi i read that you buisness acounts had the same ruleing as private acounts i dont know as a fact. but would be intrested to find out the fact in this0 -

Now that depends on where you live or is it where the bank acount is held not shure perhaps someone can answer that
but England Wales Irland you can clam 6 years
Scotland its only 5 years

simple fact is it will pay off your credit card debt wont it ?
one less to worry about a a victory over them as well0
