1 year ago my friend went £1.25 overdrawn and recieved a £30 charge for going overdrawn.
He paid this charge but they had already added another £30 for being a month late.
2 months later he rang them to discuss, by which time the charges were at £90.
They told him he had to pay the full amount, he tried to bargin for £60.He told them to take him to court.
The charge now a year later stands at £260.
They now say they will accept £60 instead of £260 and then will close the account or they say they will blacklist him.
    He is very angry.
Can he take them to court? would he have to pay the charges first and then try and claim them back?
What would you reccomend he does in his position?
    thanks for your help.

Do you mean he should pay them first? They are threatening to black list him! will they postpone while he complains, considering its already been a year?
    thanks

Yes, it;s probably wiser to pay the £60, close the account and only start the process when this is concluded.

Issued court papers against Barclays and Alliance Leicester and they were served 07/08/06.

I then got a letter from A&L offering half (no thanks) and just got papers today re Barclays.

Anyone had any luck with either of these? Barclays is about £2000 and A & L about £3K
  • Dear all,
I've worked out in the past year Natwest have charged me nearly £150 in unarranged borrowing fees and interest. I have wrote a preliminary letter asking for this back but it seems such a small amount to be mithering about when you see that some people have been claiming back thousands. I was wondering where you send the letter to. I have addressed it to the Manager of my branch. Is this right?

    Thanks,
    Lucy

    Hi
I have used the pro forma letters and exel form from this site to make a claim. I have been offered half of my claim from Barclays. The letter says I should write to accept or if they dont hear in 8 weeks then they will assume the matter is closed. Shall I write to say I dont accept? Is there a pro forma for this?

So sorry all, just read that I should post a summary...to be honest, its MUCH easier this way anyway ha ha!

4th August 06- OH took DPA letter to local branch, got hassle but nevertheless, got copy of letter (dated and stamped), also a full receipt.

8th August 06- letter received stating the letter had been passed to the Retail Regulatory Risk Team, they were very sorry and they would try to resolve this etc, accompanied by a local branch direct number on a pretty card. (Had tried to get a local no before on numerous occasions but was fobbed off and told to call the national number).

15th August 06-went on duty (NHS) and told ALL who would listen about this great site!!! Some were dubious to say thew least....we'll see whos laughing (hopefully with everything crossed!), in a few weeks/months etc!

    Okay, here goes lol...
Haven't received any any statements yet apart from my most recent one this morning...

    08 AUG CHARGES - 40.00
11 AUG CHARGES - BANKERS DRAFT FEE 12.00
    11 AUG CHARGES - S/C REFUND 12.00

There is also a Cheque no: (?) - 111111 for DPA 84 Fee of 10.00 which I presume is for my statements.

Does anyone know what an S/C refund is?....The only one Im aware of is Self Catering lol!!

Which charges can I apply for guys? Just for info, I was also charged 50.43 in interest!
Also, I have successfully got an A&L account opened now, should I immediately transfer everything to this account including dd's and wages etc. I am worried that theyll close the sccount w'o notice and then Im stumped!

Thanks as always, I look forward to receiving your replies....and my statements lol x

Write to them and say that you accept the money (however much they are offering you). then go on to say that..... however you will be applying to court to pursue the rest of the money owed. tell them they have 7 days to revise their offer.

they usually come back with a higher offer, if it not the full amount just apply to court.

  • Any ideas where I stand?

Reclaiming charges from old joint bank account when I was married, now divorced. Charges are £1050. Can I claim total back in my name only or am I only entitled to 50%?

This was a joint account but either of us to could withdraw money (reason for charges, ex kept taking money out!!).

Halifax have offered to pay £500 but I do not know whether to accept or take to court. Will I only be able to claim 50% THROUGH COURT?

    Thanks
