I've been following the advice given by Martin and on the ConsumerActionGroup site, and I see that the sample letter states to send a statutory payment of £10.

I did, twice!
I wrote to Abbey National asking for the list of charges under date protection, I didnt mention any £10 payment. They said that I didnt need to request the info under the data protection act - they would do it for free as part of their customer service (their 'nice' tone soon changed when I asked for my money back!)
I wrote to halifax asking the same and they wrote a standard letter saying that it would be sent within a 28 days. Anyway, long story short - they took 62 days to give me the info (way outside date protection rules) so they waived the fee.
Just try sending the letter and dont mention the money. They will soon reply if they want cash.2012 wins approx £11,000 including 5k to spend on a holiday :j0 -
Banks can be extraordinary. A year or two after separation and divorce from 1st husband, I went into the branch that we both used (NatWest) for something or other, and was handed about £2000 of travellers' cheques in his name. "While you're here, could you collect these for you both?"
Obviously I knew he was taking my successor on a much more exotic holiday than we had ever had with our 3 young children.
Did I accept and cash them? No, I'm afraid I couldn't. Handed them back and explained.
The response? (Once she had looked up my records).
"Well....I got a much better settlement than you did".
Makes me rather vindictive against banks. I know they are in business to make money, why not? But they should train their staff better.0 -
I have written to RBS asking they refund the fee for bouncing a cheque... incidentally they bounced the cheque in error. About 6 weeks later I still havnt had a reply. Do folks think I should write again or start proceedings now?

I asked first direct to send me details of all charges over the past 6 years. I also stated that if they could not provide this information then let me know what I need to do under the data protection act to receive this. They sent me the last 6 years statements recorded delivery for no charge.0

Yes, you can definitely claim. Go to the Consumer Action Group website and follow the procedure outlined there. It is a time consuming, but not difficult process. I have helped a single mother in a similar position as you are in, and she has recently received court notification that she's won. And her repayment is almost £2000. The only problem will be if you signed anything when they sent the 'goodwill' gesture - you have to accept any goodwill offers as partial settlement of the debt only. But all this is explained on the Consumer Action Group website.0 -
Hi,
Im about to start court proceedings against Barclays on moneyclaim online, however because I have a lot of charges,I have exceeded the amount of characters in the particulars of claim.
Does anyone know a way round this.
Many thanks.

I had a letter from natwest that says the law applies only to credit card charges and not bank charges! They basically said'go on then, take us tp court!' What now? Anyone else got to this point?Member no.1 of the 'I'm not in a clique' group :rotfl:
