  • I Have A Current Account With A Well Known High Street Branch,i Have A Overdraft Get Paid Monthly And End Up Over The Overdraft They Then Charge £8 Per Day For Being Overdrawn So When You Get Paid Next You Are In Same Boat,i Phoned The Bank Yesterday To Try And Sort It Out Someone Was Suppose To Call Me Back And Didnt.what Do I Do Know,i.e What Do I Enclose In Letter.would Really Like Some Help Thanks.

    Hi,

    I have recently been charged £23.50 for a missed payment by a Web hosting company. This would be fine if i was made aware my card details had expired and needed to update them. They only brough these charges in last month and emailed everyone to tell them. I didnt receive this as they had an old email address for me, they also sent me a reminder that my payment details were about to expire to this old email address. Therefore i never got any reminders. The first i knew was when i logged into the Website and got a popup telling me. Upon seeing this i immediately updated them and paid the missed payment.

    Where do i stand with this? I wasnt aware of the charges and the company made no attempt to contact me via phone or post. All they did was send an "email" for which i'm being charged £23.50 "Administraation charge". I questioned it and they said the charge is the same for everyone..... even though my monthly subscription is a mear £8.40!!!!!!!!!!!

    Any advice would be appreciated.

    2 weeks, 10 working days is how I have interpreted it.

    I still think they are disproportionate.

    Honouring cheques is, in a sense (tenuously!) a service you have requested, but the cost to the bank is nil. Had they bunced them you could claim, so I'd include these for definite.

    Not entirely true. They did allow one such case to go to court last year, and they won it, based on the fact that the charges were for an additional service and not a penalty.

    They haven't tried it since though, and I believe that they know they were lucky to get away with such an audacious defence.

    Just so you are aware - IT IS possible to lose. Costs were not awarded to either party.

    Ask them for a breakdown and an invoice.

    It has to be a true reflection of costs - or it becomes a penalty, which is unenforcable at law.

    Be aware though, they could very well close your hosting agreement with them if you end up suing them. You have to weigh up the pros and cons.

    In the article it says you will get the £30 court fee back. Does this mean you will get more than £30 in charges back from the bank or that the bank and/or the court will refund the fee?

    You will get your court fees back as well as your charges, plus any interest at 8% APR if you have started legal proceedings and have claimed the interest under s.69 of the County Courts Act.
