I am new to this site and am a little cautious as to how any action could affect, for example my credit score etc. One area that particularly concerns me is that if I move to claim back disproportionate bank charges, I should have an alternative current account in place in case my bank closes my account. My question is 'as many banks seem to require salaries to be paid in on a regular basis anyway, will I not have to move all transactions over in any event' ? i.e.take that action anyway and move my account, rather than have that option waiting in the wings ? If I do that, will that prevent me claiming back the disproportionate charges as the original account will virtually be nullified with that action. Guidance and views on this would be welcomed. First time posting from me but I don't seem to be able to get the answers from the posts already given. I had a debt on a credity card with Natwest 2 years ago and it got to the stage that wear a debt collection agency wear going were ringing me up, as Natwest had sold my debt on to them, can I still claim back any of these late payment charges, or becuse I have cost them money do they have a legal right refuse? Can anyone offer advice?0

just had this in the post this morning from the court( i first asked for my charges back in april 06)
To the claimant
All parties have agreed ( i have not agreed anything)
District judge beattie orders that this claim is stayed until 12th sep to enable the parties to attempted settlement.
On or before 26th sep one of the following steps must be taken:
Either
the claiment mudt notify the court that the whole of the claim has been settled
OR
the claiment or defendant must write to the court requesting an extenstion of stay period, explaining the steps being taken towards settlement and ientifying any mediator,expert or other person helping with the process. The letter should confirm the agreementof all the other parties
OR
all parties must file a completed allocation questionnaire at the court ( i have already done this form)
where a settlement of some of the issues in dispute has been reached, a list of those should be attached to the completed questionnaire.
the list must be agreed with the other parties and must indicate that it has been agreed.
this order was made on the courts own initiativepart 3.3.(4) if you object you must make an application to have it set aside within 7 days.
What do i do from here it has been going on for months and from what i can see the judge has let lloyds have another month.

Can i claim for overdraft protection + overdraft fee and i get charged £10.00 for an account charge is this right is this right0 -

Same for “overdraft protection” which seems to be some PPI Insurance. Again cancel it.
What are “overdraft fees”, is this a charge to set up an overdraft (banks used to do that, I thought they'd stopped that)? If your bank has these overdraft arrangement charges, do not take out an overdraft with them.
You should be able to claim back “penalty” charges, like going over your agreed overdraft or the bank not paying a direct debit. These charges are usually in the £25-35 range a throw.
Go through your statements, add up your charges and cancel all the bells-and-whistles, you don’t need.0 -
1 year ago my friend went £1.25 overdrawn and recieved a £30 charge for going overdrawn.
He paid this charge but they had already added another £30 for being a month late.
2 months later he rang them to discuss, by which time the charges were at £90.
They told him he had to pay the full amount, he tried to bargin for £60.He told them to take him to court.
The charge now a year later stands at £260.
They now say they will accept £60 instead of £260 and then will close the account or they say they will blacklist him.
He is very angry.
Can he take them to court? would he have to pay the charges first and then try and claim them back?
What would you reccomend he does in his position?

I have just filled in the 1st claim letter and sent it to the Abbey Customer Satisfactory Centre. I am Claiming £3698.06 since I opened my account in 2003.
I will keep my progress posted.

He needs to write to them first - see HERE to get copies of the correct wording.
He should get it back even if he has to apply to court.2012 wins approx £11,000 including 5k to spend on a holiday :j0
