The above is misleading. You could calculate it then, while you're waiting, so to speak... But you can NOT claim the 8% APR until you file claim in County Court. The relevant legislation is S.69 of the County Court Act (can't remember year right now).0 -

I entered Judgment using Moneyclaim.gov.uk against Natwest on 27th June for a 20 "late payment charge" plus issue cost and interest.
I received a cheque in settlement today, no apology of course but the following text:
"We believe that your Particulars of Claim disclose no reasonable grounds or cause of action against the Bank. However, we believe that, given the amount of your alleged claim, it is not commercially viable nor cost effective for the Bank to defend this claim.
Therefore, I am writing to advise you that the Bank is prepared to pay you the full value of your claim being 50.25. Therefore, we enclose a cheque in the sum of 50.25 in full and final settlement of these proceedings. Please note that payment is made with no admission of liability and subject to your agreement not to court publicity, or disclose or refer to any third party, the background to this matter, and also to keep the terms of this settlement strictly private and confidential."
There are 2 clear lessons here:
i) Keep your claim as small as possible as indeed the costs of fighting it are greater than paying it.
ii) Ignore bank letters which attempt to impose conditions which they have no right to do.0 -

My question is short and sweet and apologies if it has already been asked (didnt fancy wading through 50 pages of postings). Do people in Scotland follow the same process for reclaiming bank charges?

For a creidt card should I use "Credit/Store Card Letter Template (thanks Bookworm01036)" at Consumer Action or modify the "Letter - Preliminary approach for repayment." ?
