    I am sorry if I sound really dense here but I am unsure on one thing. On the letter that you send to the bank requesting repayment of charges, it says I enclose a schedule of the charges that this letter relates. Do I have to type a separte sheet with all of the details on or is there another way? I have £3686.00 in charges to try to claim back so you can imagine how many entries there would be. If there is an easier way that typing them all out individually I would appreciate knowing.

    Thanks for this I was going to ask exactly the same question - Anyone on here help please with the answer - has anyone managed to claim and won in scotland ?

    No it is slightly different for scotland.If you go to https://www.consumeractiongroup.co.uk there is a forum there specifically about claiming in scotland.

    I haven't seen any easier way so I think you have to type the dates and amount.

  • I have requested a reclaim from 10 banks, store cards etc. Some have paid up. A few summons have been issued. One has reached allocation questionairre stage. I have reclaimed the interest charged on the fees (some interest was 29.5% and for around 2000 days) Some interest was variable depending on bank rate and whether overdraft was higher than the agreed limit. I calculated according to the higher amount throughout because it was too longwinded to try a more accurate approach. The banks appear not to bother calculating either and simply pay up the whole amount. The question is, In the event we list the interest inaccuratly, is it up to the bank to proove a more accurate figure?
  • Oh I forgot. One defense from a summons was based upon the summons being issued "...incorrectly as 'Lloyds TSB trading as Black Horse Ltd'. The correct defendant is 'Black Horse Ltd' which is a finance company within the Lloyds TSB group....." What difference will this make? I doubt it will make any, because I still expect the £275.00 claim to be settled before any hearing. However, in the event of the hearing actually happening, should I go through with the hearing and lose on this technicality and then re issue?

    Don't count on this there has been onother thread on this board where the bank issued a counter claim for one of the bank charges which they had already paid back to the claimant. They do check.

    Well with Inland Revenue if they charge you say £100 for late return of your tax return, legally they can't charge you more than the outstanding amount of any tax owed. I don't know if it's because of a similar clause.

    So say (like me) HMRC tried to charge you £100 penalty for a "late tax return" (it wasn't actually late, but that's another story!) and you owed £0 in tax, then they cannot impose any charge. :D

    I've just registered on the forum on the CAG site, I haven't started to reclaim from the Co-op yet - I've applied for a basic bank account with Natwest in case Co-op shut me down lol. I've got all my statements though I haven't added up the charges yet. Just waiting to hear from Natwest.

    So I'm organised and ready to go. Sooooooooooo, why am I nervous? :confused: Nothing scares me usually. The absolute worst that could happen is I get nothing, right?
