    Nat West are defending the claim for repayment of charges. They are going down the line of the charges are for an extra service and therefore not a penalty, and thus legally enforceable.
    Please can some one give me some tips as to how to proceed with this? I have got to send them more info by 21st July and am now starting to panic abit! I can not let them get away with it.

    I think I may have a problem with Lloyds. I filled in a request for info on charges letter and took it into my local branch with the £10. The woman there said i do not need to pay the £10 but said she had heard something about it so went out back to check. When she returned she said I definatley didnt need to pay it and said she would take my letter to check there was no missing information. She read through my letter and then took it out back to show her colleague and returned without it saying she had put it in internal mail. I asked her for a reciept and she gave me one but she said, 'I didnt put any info about what was in the letter, just that we had recieved a letter and forward it to bristol'. She signed and dated the reciept tho. This was 2 weeks ago and I've heard nothing, I had a bad feeling about it when the woman took the letter away from me. I asked the woman for an address and phone number for the department it would be sent to and she told me that they didn't have that information. So I know they sent it to Bristol but I don't have a number I can ring to check they got the letter and I am not really sure what I should do next, any ideas? I think I am going to find this a real struggle to get my money back, but it is necessary, I am overdrawn and getting in a lot of trouble and the whole overdraft is purely charges, its not good. Any help appreciated, thanks x
  • I went through 6 years statements, calculating my bank owed me £1350. I sent the letter and have got no response. It's been 14 days. What should I do? They can always say they didn't recieve the letter if I continue with the claim I suppose...

    I think this is great, about time we started hitting back at the banks.

    I just got back from a weekend away and had been charged £39 by the Halifax for a £11 bounced cheque and £30 overdraft charge by Barclays. I read through a lot of the advice on MSE and CAG and decided it wasn't worth my while to go through the procedure for these charges so instead I phoned my banks.

    Halifax where easy as I'd never been charged by them before, I asked them to refund the charge as a goodwill gesture and they did immdiatley. :T

    Barclays where a little more difficult because I had been charged by them before and had argued and got the charge refunded at the time, it was a couple of years ago but they still have it on record. Custmomer service where really nice, she um'd and ah'd a bit before finally saying she'd see what she could do, I was put on hold and she came back and said the charge will be refunded. :j

    I've emailed the link to Martins article to everyone on my email list.

    Any ideas anyone....

    I have sent my letter asking for the refund of my charges, stating a reply within 14 days. They have just sent me a letter sayig they have received my letter and that they will reply within 4 weeks....

    Can I take it further after the my 14 days or do I have to wait for the 4 weeks to pass....

    What charges did you claim ? For example, a fee to arrange an overdraft is not unlawful. Neither is a £10 annual fee to run an account - this is because these are services provided by the bank. However, unpaid direct debit fees are unlawful.

    Stick to your timetable not theirs :)

    I sent off a DPA letter to MBNA Europe credit card on the 4th July. This morning we (I say we because I am doing it on behalf of my husband) received a letter acknowledging my letter, and enclosing a copy of their internal complaint procedure leaflet for my information.

    They say I will receive a full written response within 28 days from the date of receipt of my complaint. Are they saying I need to make a complaint and then they will deal with it? or do they mean they are treating my letter as a complaint.

    I am a bit scared now.

    I wrote direct to IF about claiming back my bank charges, but came across a boundry when it came to taking to them to court - a small problem called a Scottish Border!!

    The court advised me to use an English address on the claim form, so I used the Halifax address at Trinity Road.

    I did win my case and got all my money back, but was told that Intelligent Finace was just a trading name of the Halifax and should of submitted my original claim to them direct!

    So - just for info really to anybody who hasn't started with the IF yet and wishes to. Go straight to Halifax Plc, Trinity Road!

    I've added up £841 of fees on my Natwest account. My question is following the news that cases are being thrown out of the county courts (see http://www.thisismoney.co.uk/saving-and-banking/article.html?in_article_id=410687&in_page_id=7)
    ) should i write the 14 day letter, or should I wait?

    The test case involves a customer in dispute with Lloyds TSB which will be heard by London Mercantile Court. Cases at the Mercantile Court relate to commercial or business matters and are heard by a judge. "
