Hi
I have a HUGE overdraft of £4500 and on numerous occassions have been into the bank to ask for help, but the only way they could help me was by offering me a loan, remortgage or credit card.
Anyway, refused their options but stuck with huge interest to pay each month. Anyway, odd times I've gone over the overdraft, not a lot, but then they charge me £30+ pounds knowing i'm in diffuclty. Can I claim for going over my overdraft as well as fees when d/debits have bounced.
I presume I can't claim for interest, etc. I'm just in the process of requesting my bank statements, etc. Rekon there will be at least £2000.
Wish me Luck!!!!!0 -

Can any one advise as to my next step?
I had started court proceedings against a company Clydesdale financial services which is part of barcleys
I have had a credit agreement with them since 2002 and on checking my statements found that I had charges of over £400 for late payment charges. The charges are £22.50 for the first computer generated letter and then 14 days later a further £22.50 for c g letter this amounts to £45 monthly
I duly paid my court fees after unsuccessfully trying to communicate with the company
I had a date set by the court to hear the case 22 august
But today I received a letter from the court stating that:
Quote
Before district judge ******* sitting at Gloucester county court
Upon the courts own motion. The court has made this order of its own initiative without a hearing. If you object to the order, you must make an application to have it set aside or stayed within 7 days of receiving it
IT IS ORDERED THAT
The hearing on the 22nd August 2006 be vacated and the allocation to small claims track cancelled
The action be stayed until further order on the basis that there is likely to be a test case before a Higher
Court before the end of the year the result is likely to reduce the need and/or amount of litigation in these types of cases
Liberty to apply to remove stay
....
Do these mean that I have now lost me court fee as well?
No, you have not lost your fees. The Court has stayed the matter indefinitely on the assumption that a Higher Court will soon decide on a similar case and provide a Judgment that will bind lower Courts (eg County Courts).
The Court should not be vacating hearings and staying proceedings in this way unless perhaps they are aware of a specific case which is shortly to be decided on this exact issue. This is unlikely. Therefore, apply to remove the stay and for a new hearing date. Justice delayed is Justice denied.0 -

I agree that maybe the credit card is not the way forward. I'd also agree that increasing the mortgage, and making your debt 'secured' has its pitfalls.
But surely a loan would have been the answer. The loan would almost certainly be given at a lower APR than your overdraft EAR, and would mean you had a structured plan/timescale for returning back to the black.
I have a very large overdraft, which is around 160% of our joint monthly income. I've been with my bank over 26 years, and they know that, should I ever use the overdraft, our normal monthly credits will largely repay it within 30 days.
When you were "asking for help", were you asking them to extend your overdraft further? How does the £4,500 (or the additional overdraft you were seeking) compare to your monthly credits to the account?0 -

Not sure if i am posting this correctly?
I have read the link but still very confused - do i just complete the N1 form now and send to the bank to start my claim??
Sorry to be such a pain, but I am sooo confused, but determined not to give in to Lloyds TSB!!0 -
I've told my son, who is also with Lloyds TSB, all about this thread. Lloyds have today sent him a letter saying they can't make a standing order payment because it would leave him £58.79 overdrawn but have charged him £35 for telling him! The money was put in the same day as they sent the letter! He reckons they owe him £1500 min for the past six years as they continuously charged him all the time when he was at Uni.
Do you need to get hold of the past six years bank charges amount before you send the letter? I have read back through the thread but can't see an answer, or else I've overlooked it. Many thanks.

Hi all,
I recently went travelling for 6 months to Thailand & Oz. Whilst over there I used mt Barclays current account debit card to withdraw cash from machines. It wasnt until I got home that I noticed massive amounts of interest / charges for the pleasure of withdrawing my cash abroad.
Can I reclaim any of these charges? & if so how do I go about it?
Thanks0 -

from what i gather if he knows exactly how much each of the charges were made against him, when the dates were and what they were for he can go ahead and claim
If he doesnt, thats why you need the last six years of statements,So you can work it all outIf you dont ask you dont get!!0 -
Thanks for that reply Jaygrunt. He doesn't know the exact amount unfortunately so he'll have to ask the bank for copies or amounts, whatever.
I've registered with the consumeractiongroup but I haven't had the registeration email. I'm on AOL and they have said on the site there is a problem. I've contacted AOL and they're going to look into it but say it isn't their end etc etc, hence I can't post on the forum  . Has anyone found a way round it please?? Thanks.0 -
Is there a minimum amount, can I claim back for late fees of £15 ?Nice to save.0
