    I've got two accounts with the same bank that I want to claim charges back for, and am trying to figure out the best way to do it. Once everything's settled I'm switching banks.

    Hi, just a quick question. I've just found out that I dont have to pay court costs because of the benefit I'm on. Do I just have to take proof of benefit to the court and ask for an N1 form?

    You need to fill out the form EX160a and take\enclose the proof of benefits etc.

    If they exempt you then they'll process the case, if not they'll send a letter.

    Read the form, it's all in there.
  • Hi, in respose to Zoeo post I am not surprised to hear that you are having problems getting the infromation you require.
    My husband and I have written to HSBC to request the same infromation as you. They wrote back saying that they too can only supply statements, not a list of the charges and why we have been charged. They have not given us any chance to say 'no thanks' to the statements. Consequenty we now have probably 60 envelopes containing statements which we didn't ask for and will be charged at a rate of £1 per envelope.
    Last night we phoned them to say we wanted them to stop sending them as this is not what we asked for. My husband was cut off by the call centre worker when he asked a tricky question and when I asked for the address of the data protection dept I was infromed that there is no such dept within the HSBC system! I was told that I have been supplied with duff information and the £10 list i require is ,apparently, not available to me. Once again thay tell me the only way to have this infromation is by statement!!!
    Don't they make u sooo mad. I feel in our case, and probably yours that they know exactly what is going on and are deliberatly making this process as difficult as possible.
    Let me know hoiw u get on with them cos it sounds like we are at the same stage of the process.
    One more question, mt bank never send me a letter to say that I have gone over my overdraft. Instead they add the charges at the end of each month.If i am over by £30 they charge me £30. Am I able to claim that back as in theory they have lent me that cash for a day or two. Is it only returned dd etc that I am entitled to? Am I not understanding the process properly?

    LLoyds TSB have provided me with breakdown of charges for last 6 years ( over £2000) Despite sending 2 letters (as per templates) they are still denying that they are unlawful. In the last letter I asked that if they still insisted this, that they provide me with a full breakdown of the costs they have been put to, as a result of my breaches. I said that in the absence of this specific info, they are presumed to be unlawful.
    They have not provided this info, but have just said that if i wish to pursue the complaint, i should write to the Financial Ombudsman and that this is their final response.
    What is best to do now? Make a claim to the bank and copy in the Ombudsman or start the process over again with the Ombudsman?
    Please help me if you can, i will be very grateful

  • Just got a letter from Solicitors for HSBC wanting a breakdown of the charges - I take it it's the spreadsheet - do I include the interest column in the printout?

    Hi, just after some help, at the stage of putting in a claim, just want to make sure I get it right. Brief details of claim, do I just put... I wish to claim unlawful charges back from my bank.? Also am trying to work out the interest, am sorry but am not very good at this. I done the sum like it said (to calculate the daily intersest) came up with 0.12606 so do I put the daily interest as 13p? The date when the money became owed to me, is this the date that the 1st charge was taken from me upuntil now? How do I work out the 8% inerest? The section you have to include to claim interest, do i add this to the section. brief details of claim or do I add this where it says particulars of claim?
