    They do, but the procedure is a bit different, and tbh, I'm not totally up to date on NI, so click on my sig, register (free) there and browse the forum to find out. Sorry I can't be more specific.

    Which stage are you at? Prelim, LBA?

    If prelim, then send 2nd letter edited to say no thks to partial offer, and you're giving them another 14 days to pay up in full.
    If LBA, say no thanks and remind them that only FULL refund before X date will stop you from filing claim, at which point it will cost them 8% APR and court fees.

    I know I am being dense but were is the second letter?
    I trawled through about 15 pages yesterday and couldnt see it :o

    Where are you looking? If it's on the CAG site, it's in the library, "Letter Before Action", same place as the others. :-)

    Hi everyone,

    I have an account that I have now closed, due to the problems that I have had with them. Is it still possible to try and claim these charges back from them even now?

    Also, I havent checked, but what it states in the bank's T+C's that they would charge £x for an unpaid dd? Are we still able to try and claim that back from the bank?

    Got an offer to settle from Abbey today - YEAY.

    It's 2/3's of what I'm claiming so I'm going to accept it. They are also throwing in interest and court fees so I'm a happy bunny now. After all it's money that I thought was gone forever and I'm not in any debt now - no thanks to the banks!!!

    I've got a parachute account set up at the Woolwich in case they try and close me down later as well.

    Yeay - I have free spending money for my holiday and I can use the money earmarked for that on school uniform now - lol.

    In my opinion if you have been charged on more than one occasion you know what will happen if the situation occurs again. I would simply advise that you stick to the rules (like the vast majority of customers do) and the bank will stick to their rules.

    But how is it fair that those in society least able to afford it have to pay exhorbitant fees when they go over their limited income?
    The banks would have us believe that if these charges are abolished, then the concept of 'Free Banking' would end in this country. But can they honestly defend 'Free Banking' which is in effect is subsidised by the less well off?
    A blanket charge for everyone plus a "REASONABLE" charge for going overdrawn, bouncing cheques etc. As the law states, this charge should only cover the expense that has been caused to the bank by the misdemenour. With so much of the Banking support now shipped out to India, it's amazing that the subsequent savings haven't been passed on to the consumers isn't it?

    Hi there,

    I recently sent the request Data Protection Act letter to Barclays and received a response from Pete Townsend in their DPA department.

    They returned my cheque for £10 saying "Please be aware that the bank is not under an obligation to present information according to any particular format. Therefore, your request to assemble a schedule of charges is turned aside. You may of course obtain this data from copy statements and these will be supplied to you shortly without charge on this occasion. As the bank is providing the copy statements on a complimentary basis your cheque is returned herewith."

    However, at the bottom of the letter it says

    "Notwithstanding the above, the bank is of course entirely willing to supply the general information that shoul dbe disclosed due to teh Data Protection Act. To initiate the process Barclays will require payment of £10 fee per individual which should be provided by cheque, payable to Barclays plc. Upon payment of the fee the relevant information will be supplied as promptly as possible."

    Now i am confused, first they say they will provide copy statements free of charge and then they say i have to send them £10 for the Data Protection Act information. Has anyone else received this letter and later received their copy statements? The letter is dated 2nd June so there is still time before 40 days is up. Do i need to send another letter or shall i wait and see if they copy statements do turn up?
