    You can get the forms and use the post. I would if they hadn't paid me - but they did. However, I have a couple of other people who have not, despite having court judgements.

    Judging by the continuing accounts on other sites, the group of sites operated by A1 Comms hasn't sorted any of its problems out; they are still using the same lame excuses, making promised they don't keep and (in the large numbers) not paying. I have another payment due in the next two weeks; I will be very surprised if it doesn't arrive given how much I have cost them already, but if it doesn't I will immeditely pull the trigger on another action and follow it through to the hilt. Then again, I have made so much from cashback deals over the last 7 or 8 years that I am more than willing to proceed to whatever stage they require. I understand it may be a big call for others, though.
  • My 2nd cashback claim was accepted in March, not paid yet. I've been given the runaround, so am about to send them the LBA.

    I've not noticed it mentioned anywhere, though I may have missed it. Can I claim the cost of the recorded delivery for the LBA? Not a problem if I can't, just curious.
  • Only if you do it that way. No need to send it rc - I send mine by email nowadays (including my latest - though my claim relates to July so I never undersand WHY people leave it SO long before following the groundrules, one of which is take action the first day the payment is late).

    Hard to say why I've left it so long. I've done plenty of cashback deals and this is the first time I've had any problems, so I think I accepted their excuses to begin with.

    In early August I had an email from them confirming they'd received and authorised my 3rd claim. As mentioned on here, it no longer contains a timeframe by which it'll be paid. In that case, assuming they don't pay it, when would you think was the time to send the LBA?
  • Send it a couple of weeks before the 58th day from acceptance. If you look on-line you'll probably find they say you'll receive payment over two weeks before the (old) 58 days.

    Irrespective of whether they (now) include timeframes in their email notification, it would be unreasonable to a) allow an indefinite timescale - and 58 days is not a reasonable timescale anyway and b) It would be unacceptable to expect a longer timescale than they have (up until now) given. You can then sue on the 59th day if you haven't been paid (I do).
  • Got a problem myself with this company despite being a loyal customer for 6-7 years with no issues before.

    Ordered a new phone on 3 with free PS4 on 15th August. The phone turned up promptly but as of today the PS4 hasn't been received. They say they guarantee within 30 days. Its now day 38. I've sent in a request via the contact us page (no response), contacted them on Twitter (the matter was escalated) and phoned them. The PS4 is in stock, the redemption has been approved but still nothing.

    I really don't know where to go with this now so any advice/links would be helpful.

    Send a LBA giving 7 days to supply the PS4 or you will start proceedings for the cost of replacement.

    Letter Before Action .....you don't need a template, just quote the facts ie. it has not been despatched as promised despite many efforts to chase it up etc etc. Send it email with a follow up copy recorded if you wish.

  • LBA means Letter Before Legal Action (or Proceedings). You therefore do need to include a timescale for them to deliver what they contractually owe and a statement of what action you will take/claim etc.

    It may help to know that I've had substantial dealings and issues with this company this year. I have needed to take action several times, but I am satisfied that this isn't malicious or intentional - I think they have other problems which they are definitely trying to sort out.
