Please tell me you're not serious? And you say this is with Experian? If so then I think you ought to email my mate directly (lee.hancock@uk.experian.com) and tell him the facts and he will get it wiped for you.

If not then go to his boss; andrew.mills@uk.experian.com

If you weren't even 18 then tell them this and they will take it off!

Brilliant, I thought and hoped that they would remove the info under those grounds however it is not there decsion or at least I'm told.....

Nope it isn't their decision but, and this is the big but, if you can prove that you were not 18 then the debt cannot be legally enforceable anyway and experian know this. As a result, with them displaying the data each time you get refused credit they are breaking the DPA and you should complain to ICO and they would have fixed this months ago..... it is sooooo easy to get sorted, I wish mine were!

Right the facts:

1. You were not 18.
2. It was not you
3. The ICO state that data must be accurate and not cause loss or financial loss to anyone

The truth:

1. Tell Experian this. If they do not remove the data immediately and forever then you'll sue them for libel each time a lender searches your report and declines you. tell them you'll make 20 applications a day and if any lender writes to you saying 'sorry.... becuase of info contained within your credit report' this equates to libel and andrew mills & lee hancock both know this! They are the legal eagles of Experian (directors office, i.e. the top men) google their names mate and see for yourself...

2. I'm assuming you lived at home with the parents at the time the phone was taken out? If so then council tax/electoral roll will confirm this so will a copy of your birth cert

3. Speaks for itself.

Are you following me here? If you show the CRA that you were not 18 at the time the debt arose then they must remove the data from your file because there is no way, even if it was you, that you can be liable as minors cannot obtain credit legally!

Not upto orange - its the law for a reason and if they refuse to budge, use the law to your advantage and make sure you claim compo! Lots of it for the hassle and inconvenience (from orange)

The fountain of info I say - I've got the same address written down but with fraud dept as oppose to credit referrals. I managed to get a fax number aswell. I may send over my birth cert tommorow.

To tell you the truth, the guy from experian told me that he has issues with Orange himself and he had to go to the ICO. He said Orange would remove the data and then issue it again every month on there updates....
