You will then be able to show the court that their defence is incorrect - where they say they have paid the claim in full, you will be able to give the courts proof (copies of cheques received + bank statements) that they have not done so, and still owe you £x from the claim.
If it goes to a hearing this will be in your favour - as it seems to show they are accepting your claim in full (particularly as they are paying your court fee plus interest), but are wrongly trying it on with the figures.0 -
BACS payment is usually processed on the day it is issued, whenever i have done a BACS recently its showed on my account by 4pm that day. Thats NATWEST (nothing to do with MR though!):j :beer: :j0

I haven' received any of the cash back claims(four) from mobile rainbow. I have just finished my one year contract. They are just writing that I will be getting it within 7-15 days since last 6 months. I want to take some legal action now. Has anybody done this before? Can I get some more information about this? How to proceed and approximate expendiature for court action?

Thing to bear in mind is that this is just a Code of Practice from OfCom so there are no legal requirements for the companies to follow it.
atmn, start legal action immediately claiming all of the cashback plus court fees. Use the money claim online service from HM Court Service. They are quite used to using this service as quite a few people on here have taken legal action online.
An update on my case. MR have responded to the Allocation Questionnaire. I would be interested to see what they came back with. It is going before a judge today who will decide if it needs a trial or if he has enough information to make a judgement..0 -
I recently filed court claim for whole amount against Mobile Rainbow after not receiving 1st and 2nd instalments and just sent 3rd. They have filed a defence which i have not seen yet, so will be passed onto court. Today, however, they have also paid into my bank £175 (being the first two instalments + £25 court fee). Ha Ha Ha. I will be notifying them a thankyou for Part payment of my claim and keeping the case open to go to court, otherwise i'll just be going through the whole routine again in a couple of months. Keep you updated.0

My claims for months 1-6, 7-8, and 9-10 are all now over due. I met all the terms and conditions which they acknowledged through email. I filed a court claim for the first 2 installments (which contained copied of all the emails they sent saying that the money would soon be with me). They didn't even reply, which I guess is good because they havn't tried to defend themselves. Ive requested judgment now that their time has expired. Does anyone know what is likely to happen now?
I'm going to wait until the last installment is due before claiming for months 9,10,11, and 12. They are now ignoring my emails asking them to comfirm that these claims and have been recieved and verified, so i hope that won't be a problem!0 -
Hi All,
For those who are suffering from Mobile Rainbow and not getting their cash backs paid by them after waiting 8 weeks as they state in their terms and conditions, do the following:
1. Send them a warning letter of Poor services to their complaints dept. (Recorded delivery). A template of this letter can be obtained from Consumer direct website (http://www.consumerdirect.gov.uk/after_you_buy/making-complaint/template-letters/poor-services/).
2. If you haven't heard from them within 10 days, send a final letter warning them that you'll take the matter to court should they fail to pay you within the next 10 days informing them that you have send them a Poor Services Letter in which you did not receive a reply. Enclose a copy of the Poor Services Letter you sent (just in case and to cover your self in court should things gets messy). Send this letter by Recorded Delivery again as a proof to show in court.
3. Should you not hear from them (most likely), go to Money Claims Website - HM Court(http://www.moneyclaim.gov.uk) and file a complaint, all done online with a fee of £25 (The loosing party Mobile Rainbow will bear this cost and add it to the pay back). I dont need to go through the detail of the procedure, it will all be explained on the money claim website. YOU WILL NOT ATTEND ANY HEARING, its all done online and very easy. Don't let these people run away with your money, go n get 'em guys
Month later, Mr Msols Limited will pay you your cash back + £25 court fee. I got my money just today. woohoo :money: Mobile Rainbow

I too wanted to take court action against Msols Limited (suppliers of mobiles to Mobile rainbow, orangemobile shop, Direct phone shop etc) using the correct procedures posted in these forums.
I also contacted T-mobile to vent my displeasure at their attitude and T-Mobile allowing their contracts to be used on these sites.
Today I have received an e-mail reply from T-Mobile who have confirmed to me that Msols has CEASED TRADING!!! and will not be paying any more cashback.
I checked company's house website who have MSols as still ACTIVE! I have also reported them to Hertfordshire Trading standards.
Can anyone else confirm or deny if they have stopped trading as I don't wish to waste money chasing them through the courts for nothing. I presume nobody will get a reply for MSols confirming this either.
