    Continuing from my previous post, I have now received an email response from Mobile Rainbow. Here is my reply to them plus their email.

    Dear Mobile Rainbow,

    Thanks for your email. I have checked my records again here and all pages were definitely posted to you.

    The only possibly discrepancy I see here that could have confused you is that on the October bill the first page of the bill reads “Page 2 of 4”. I’ve checked with Orange and that is an error on their part. I can prove that this is indeed the first page and that no pages are missing. In any case, if you look at that page, it is clear when comparing to the others that it is indeed the first page in terms of it’s contents and layout. For the other instances where you say page 3 is missing, there is no evidence to support that whatsover and if you genuinely can’t find these pages then you have obviously mislaid them.

    As stated in my previous email and letter, I have conclusive evidence that all copies of the bills have been posted. In light of the possible discrepancy in page numbering on Orange’s behalf confusing you, I will extend the deadline to 18th December 2007. If I have not received payment, I will deem our agreement invalid and claim for this cashback and all subsequent cashbacks through the small claims court.

    Weird how my October bill's first page reads 2 of 4! Anyone else had this happen to them? It's definitely the first page, I've double and triple checked. I've given Mobile Rainbow a little longer as stated above.

    Incidentally, Msols looks pretty solvent to me looking at their accounts - can't see that there's much basis to liquidate. If they did, I think there would be a fair amount of assets for their administrator to put towards creditors. I'm not an accountant though, so don't take my word for it. Just what I can deduce - it looks like a healthy company. Just with not so healthy business practices!

    Had a email response from them today with regards to my cashback... they are refusing to pay because I sent it in month 7, and not month 6.My argument now is as follows;- When I repeatedly asked MR in month 6 whether I should send it in, they said I was in month 5 and should wait for my next bill and send it together with that. I have a written email from them confirming this.- When I sent my bills 1-7 last month, they told me that they hadn't received it - even though Royal Mail confirmed it was delivered. After repeatedly telling MR that it was delivered and giving them the Royal Mail reference number, they still denied receiving it. It was only when I threatened with court case that they magicly seem to have receive the post and have now told me it's late - because not sent in month 6, but in month 7.I will respond to them again threatening court action, because its their stupid staff giving me incorrect information, so they should take liability for this. I understand its partly my fault for not interpreting the contract (month 6) properly, but I went on their word.

    When werethere last accounts filed.

    Things change pretty rapidly.

    PBD had £250000 of assets but 4-10 million of previously unalocated debts.

    All terms were complied with as I have stated in my previous emails. All pages of the relevant bills were sent to you by the due date and I can prove this. I will be issuing my claim through the small claims court on December 19th unless I receive the monies owed as stated.

    Last accounts I can see are for 04/06 to 03/07, so up to date. Their turnover and shareholders funds have been more than doubling year on year since 2005. I'm not sure if I should be divulging the actual figures here from a legal point of view... but for 2006 their turnover was over £1.5 million and they had £250 grand in the bank.

    Note that £250 grand is what they had in cash at the time of the accounts being filed. It's just a snapshot, so you can't equate it with number of cashbacks per week.
  • I'm still waiting for a response to my claim (for 3 cashbacks: they paid the 1st eventually, 2 are overdue so claiming for the final one too). It has been acknowledged and I think they have just under a fortnight left to respond. I'll let you know what happens.

    Well they seem to be adamant that they haven't received all the pages of my bills. I have all the evidence I need to prove that they all were posted. So my claim will be filed on 19th Dec assuming that they haven't paid by then.

I still expect my 1st cashback to be paid in full by Dec 18th 2007 as the apparent loss of these pages has occurred on your part. If I haven’t received this cashback, I will deem that you have not honoured your part in our agreement and I will claim for the 1st cashback and all subsequent cashbacks through the small claims court.
