    OK, Sent my first cashback claim in Nov, special delivery, was signed and recieved within time (but never had an e-mail verifying receipt) and haven't heard back and surprise surprise no answer from any phone line....

    What do I need to do before I issue proceedings against them for full amount? DO I need to show I've e-mailed and written etc? (Don't really wanna waste time hanging onto a constantly engaged number knowing I'll be fobbed off too, jst want to get straight on with it).

I dont need to go through the detail of the procedure, it will all be explained on the money claim website. YOU WILL NOT ATTEND ANY HEARING, its all done online and very easy. Don't let these people run away with your money, go n get 'em guys

    Hi Rasker, the link to the letter no longer works, and the letter for 'poor service' on the website is not particularly relevant to rainbowmobile as the goods received are fine, just teh cashback service.

    May I have a copy of your oroginal poor service letter and also your court form as templates please? (Of course you have the right to say 'do your own research' but why should I waste more time on pursuing these scumbags? I do hope you can help.

    Yea they have now switched from the free no to a 0870 no but i still cant get through. I am waiting on 3 cashback claims dating back to july last year,infact when i first complained they said it would be paid in 3-4 working days, but that was back in sept, i am writing them a letter and giving them 7 days to sort it out or i start legal proceedings against them. IF YOU ARE OR YOU KNOW SOMEONE WHO IS GOING TO BUY A CONTRACT FROM THEM.... PLEASE PLEASE DO NOT....

    Hello I'm New!! I got a 3 mobile 12 month contract last Feb and of course haven't received cashback yet. I read all the advice on this site and issued proceedings against MSOLS. I was amazed when they filed a defence saying they had paid cashback into my bank, they hadn't and they still haven't. I sent the allocation questinnaire to the court, but as this is the first time I've done anything like this ... what happens next? Thank you to all the previous people giving advice about this.

    UPDATE.

    Sent Mobile Rainbow copy of Allocation Questionnaire and notice giving them a further 5 days before i filed it. Also, further helps my case, as proves to court, i have tried several times in vain to settle this without court action. Just got a reply back saying they had'nt received my 3rd cashback claim? Muppets! Not even relevant, as the claim was filed and contract breached prior to this. Sent it anyway when it was due (just in case). SO, have sent Allocation Questionnaire back to court, next step court date, BRING IT ON. I'm almost hoping they don't pay up before the hearing, i'd love to hear what the judge would think of them.

    Issued a claim against mobile rainbow for the full amount due , as they have breached terms and conditions on 1st and 2nd cashbacks paying them very late only after legal action.

    This time they intend to defend the entire amount, have not seen their defence yet however.

    Just wondering, will consumer reviews from sites like this and others such as review centre, ciao stand up in court as evidence against mobile rainbow? As there are literally hundreds of reviews from ppl with the same problems.

    ive been on the watchdog site and filled in a short form regarding the inept mobile rainbow. Can anyone who has had bad service from these idiots please do the same as i think the more people who do the more chance it has of getting on the program and warning others.

    You might like to remind whoever completed/signed the 'defence' what a Statement of Truth is. Then refer them to the MCOL site where they will be able to find out what the consequences of filing a false Statement of Truth can be for an individual.

    These organisations treat the Court system with contempt using their ridiculous and dishonest 'defences'. If they could be discouraged/stopped from so doing it would speed up the system enabling people like yourself to get your cash back quickly.

    It's a long shot but you might like to try and contact the signatory to the 'defence' and, using the above, try to convince them that it is in their best interests to settle quickly as, should the case go to Court, you will be pointing out the dishonest 'defence' to the Judge. Also might be worth giving MCOL a call, see what they advise.

    Hello! Although i'm taking mobile rainbow to court, I doubt if they will be trading for too much longer :mad:
    How about a competition guessing the last trading day??:rotfl:

    Has this clause always been on the Terms & Conditions for orders placed before May 2007 ?

    13.11 Proper care needs to be taken by you while sending in the cash back claims. If any of your cash back claims is rejected as a result of any of the aforementioned conditions, then no subsequent cash back claims will be entertained.

    I dont recall this being on the original version of the terms ? Effectively it is saying that if you miss your 1st payment any subsequent claims are inelligible ?

    They still owe me my 1st payment from June last year. The next claim was late due to the postal strikes, so they are now saying that all subsequent claims are void.

    Im sure this wasnt on the original terms but I dont have a copy. Can anyone help with that ?

    Also - since the first payment is so late can I still go ahead and claim the full year plus costs ?

    If MSOLs come back with a defence and state that my subsequent claim was recieved after 15 days what are the actual chances of the court deciding in my favour due to their late payment ? (have any judgements actually been issued against MSOLs yet ?)
